TEHILLIM – Yeshiva Bochur In Coma Following Leg Injury

An American Yeshiva Bachur studying at Rav Tzvi Kaplan's Yeshiva in Eretz Yisroel is R"L fighting for his life following a leg injury while playing a football game, YWN has learned.

Sources tell YWN that the 20-year-old Bochur from Lakewood was playing football on Thursday night, when he fell and broke his leg. Hatzolah and MDA treated him and transported him to a hospital, where it was determined that he needed surgery. YWN was unable to confirm What exactly happened next, but sources tell YWN that a piece of the bone went into the bloodstream, caused a bloodclot, and R"L stopping his breathing.

He is currently in a coma and on a respirator.

A member of our Chabura Yehudah Tzvi Ben Elisheva is asking for your prayers. This Wednesday he went into Cedars Sinai for an extensive surgery to reconstruct his left femur. It will be a 5-6 hour procedure. The most important part of the surgery will be the removal of the titanium rod that is presently lodged in his leg. The last surgeon was unable to remove it and for the rest of the surgery to be done correctly it must come out.Many years ago he had a similar situation. A woman’s group through Shema Yisrael Torah Network set up a mass davening for me at the Kotel during the surgery. The Dr. said it was a miracle as he was able to remove a broken rod that had actually fused with my bone. It was said to be an impossible challenge, but the rod just slipped out easily. On the seventh day you shall rest (Exodus 23:12)
Mitzvah #32, in the “Ten Commandments,” is a negative mitzvah: the prohibition against performing acts of creative labor on the Sabbath. This mitzvah is a positive one: the obligation to rest on Shabbos. Shabbos is so important that its observance is both a positive and a negative mitzvah. (The Sefer HaChinuch points out that Shabbos is so important that the Torah restates our obligation to observe it a full dozen times!)

As we mentioned in Mitzvah #32, to rest on Shabbos does not necessarily mean what people mean in English conversation by “to rest.” It means to refrain from acts of labor. Driving appears more “restful” than walking in the English, conversational sense, but walking is actually “restful” in that driving necessitates forbidden forms of labor.

Nevertheless, it is also important for us to “rest” in the more conventional sense, as well. In the Book of Isaiah, chapter 58, the prophet tells us, “If you restrain your steps because of Shabbos and refrain from doing your own business on My holy day, if you consider Shabbos a delight and honor God’s holy day by not going about your daily business, conducting your usual affairs or discussing mundane matters, then you will delight in God…” (13-14). These verses define some forms that our “rest” takes on Shabbos. We don’t run (except to shul or to perform a mitzvah), we don’t do things that are not “Shabbosdik” (like preparing on Shabbos for after Shabbos) and we don’t discuss matters not appropriate for Shabbos, such as business. (These principles are respectively known as hiluchecha, cheftzecha and dabeir davar; they are referenced in the Shabbos zemiros in the song Mah Yedidus.)

The obligation to rest on Shabbos is incumbent upon both men and women in all times and places. It is the subject of pretty much the entire Talmudic tractate of Shabbos, but starting heavily on 51b. It is codified in the Shulchan Aruch specifically in Orach Chaim 246 and 305. It is #154 of the 248 positive mitzvos in the Rambam’s Sefer HaMitzvos and #20 of the 77 positive mitzvos that can be fulfilled today as listed in the Chofetz Chaim’s Sefer HaMitzvos HaKatzar.

[chicago-aneinu] Please Daven for missing woman

It is now nine days that the police and family of Rachel Lebetkin, 28, of Jerusalem, still have no clue as to her whereabouts.

A student at Bar Ilan University, she has not been seen since Sunday morning, Oct. 17, when she set off to take a test at Bar Ilan in Ramat Gan. She is 1.58 meters (5'3") tall, and has brown hair, light complexion, blue eyes, medium build, no glasses.

Rachel lives with her sister in Kiryat Yovel in Jerusalem. Her classmates and others have helped in the searches for her. The police do not rule out a voluntary disappearance, though her family members feel this is unlikely; she apparently did not leave Israel.

The public is also asked to pray for her welfare: Rachel Rivka bat Aharona Zissel Sarah.

Guess what. She lives in Iowa. Sound familiar?

There is a frum woman who needs our help- it won't take much time for you to do, but it can help her tremendously.

Wendy Weiner, a frum woman, (actually my neighbor's sister), is in the middle of a huge crisis. She is a movie producer by trade. Recently, the state government of Iowa asked her and others to do a few things to help boost Iowa's economy. Afterwards, the program in Iowa was shut down. The Governor of Iowa charged her for felony- even though she was doing EXACTLY what she was told to do! These charges are seemingly Anti-Semitic, because the other 25 people who did similar actions were released and freed from all charges. Only the frum woman remains. Now if convicted, she is facing 25 years in jail. She has a husband and four children who need their mother to come home.

There is one thing she asks of every Jew who hears her story: "Now I ask you to think about one mitzvah that you did yesterday, one you'll do today, tomorrow and every day. Now, make the commitment that for TODAY, you will do it “b’simcha” for Zeva Rochel bas Chaya. You can help me by adopting this attitude for one mitzvah you do every day

Ruchama Sheindel bat Henya Gittel Miriam - Jenny Morhaim (in London), wife and mother of 3 girls.



I have been informed that Jenny suffered a heart attack yesterday and is now on a life support machine. They discovered that she had a brain tumor that she was unaware of. The situation is very serious.



Please daven and ask Hashem to send a refuah shelema to our dear anduniquely kind hearted friend Jenny in London. She is married to my close friend Josh and I am very close to the amazing Morhaim family (Hannah, Alan, Sammy and Zak) who pretty much adopted me when I lived opposite them in my single days in Edgware, NW London. A greater, kinder, more hospitable Jewish family you would be hard pushed to meet anywhere on the planet. We are also friends with Jenny's brothers Simon and Alex, father Howard as well as Simon's wife Joanna. Our hearts and love go out to them all at this very challenging and testing time.

The destitute you shall not favor in his complaint (Exodus 23:3)
There are many ways that those who have are commanded to help those who have not. Those with means have to leave portions of their fields for the poor. We have to lend to the poor. A certain tithe was designated for the poor. We are obligated to help them in other ways as well. But there’s one arena in which we may not give the needy extra consideration: in court. Court is a place of justice, not of mercy. If a poor person were to steal from a rich person (for example), we would not be permitted to justify the crime. The judges must decide cases fairly, based on the facts. They may not favor the poor out of pity and, as we shall see in Mitzvah #234, they may also not favor the rich and powerful in order to honor them.

The reason for this mitzvah is clear: it would mean a complete breakdown of the legal system if judges were permitted to disregard the facts of a case and render decisions based on their personal emotions.

This mitzvah applies in all times and places to the members of a beis din. In the Talmud, it can be found in the tractate of Chulin (134a). In the Shulchan Aruch, it is codified in Choshen Mishpat 17. It is #277 of the 365 negative mitzvos in the Rambam’s Sefer HaMitzvos and #66 of the 194 negative mitzvos that can be fulfilled today as listed in the Chofetz Chaim’s Sefer HaMitzvos HaKatzar.

BDE: Body Of Steven Mayer Z"L Found

YWN regrets to inform you that the body of 62-year-old Steven Mayer Z"L was found over Shabbos.

Sources tell YWN that his body was found in a wooded area of Riverhead Long Island. His body is currently at the Suffolk County Medical Examiners Office, and Misaskim has been notified.

Thousands of volunteers from Hatzolah, Chaverim, Shomrim, and Misaskim had been searching Riverhead by land, air, and water in the hopes of finding Mr. Meyers, a Great Neck man who has been missing since October 4 – as was reported first by YWN.

Steven Mayer was supposed to be on his way to work as a metals trader in Huntington when he vanished. Family members say Mayer's cell phone used reception from a tower in Riverhead at around 3 p.m. that day.

Worldwide Tehillim Call

R’ Fishel Todd who is the Executive Director and Worldwide Coordinator of the Shulchan Aruch Project and Shema Yisrael is requesting everyone involved in the project say Tehillim for his mother Chana Zissel Bas Ester who is due to have an emergency Surgery this Monday at Robert Wood Johnson Medical Center in New Brunswick, N.J. R’ Fishel’s mother is one of only 13 survivors from an area that had 6000 Jews before the war in her town of Kalush which was then Galitzia Poland and now it is Ukraine. Due to R’ Fishels mothers advanced age and condition the Dr was reluctant to make the operation. R’ Fishel then called upon the Gedolim of our generation who responded when asked that the Dr. proceed.

R’ Fishel’s son R’ Yosel Avigdor Shilita upon hearing the report said immediately that in this weeks Parsha Lech Lecha we also learned about an operation (bris mila) and Avraham Aveinu asked Mamrei also about his operation [rashi 14:13 in Lech Lecha], who also advised him concerning particulars of the operation. R’ Fishel advised the Dr. of the Gedolims instructions that the operation proceed. R’ Fishel explained to the Dr. the concept of Emunas Chachamim and that the one doing the healing is the Malach of Hashem Yisborach. R’ Fishel further added to the Dr. that the bigger the Dr. the bigger the Malach, so R’ Fishel added in his usual style that “I hope you are a big Dr.”

R’ Fishel’s grandmother Ester bas Avraham H’KD fasted forty from Rosh Chodesh Elul until Yom Kippur plus every Monday and Thursday. When R’ Fishel’s family moved to Lakewood N.J. his mother made sure that he go to Yeshiva never imagining one day from this one survivor with this one son would come a perush on Shulchan Aruch and 10’s of thousands of talmedim around the world. Do not respond to a controversy by bowing to the majority (Exodus 23:2)
If a judge is inclined to acquit a defendant, he may not change his vote to guilty just because others are doing so. It doesn’t matter if it’s because the majority are voting guilty or because greater scholars think the defendant is guilty; if this particular judge thinks the defendant is innocent, he may not defer to his peers. He has to analyze the facts of the case himself and reach his own conclusion.

This would be an easy thing for a judge to justify. Judge Reuven might think, “Judge Shimon is a great man and surely knows what he’s talking about. It’s good enough for me to follow him.” But it’s not. Judge Reuven made it to the courts on his own merits and he now has to use his skills to do his job; if God had wanted Judge Shimon to have two votes, the Torah would have allowed him to hold two seats!

Included in this mitzvah is that a person who argues the merits of the defendant in order to acquit him cannot then turn around and argue to convict. Many other details of court cases are learned from this. For example, there is a right to a presumption of innocence for the defendant; if all the judges start with a presumption of guilt, it’s declared a mistrial. Also, the rule is that a court starts with the junior judges and works its way up to the senior judges so that the senior judges’ opinions should not unduly sway the junior members’ opinions.

The reason for this mitzvah is that, if every judge defers to another’s opinion, it’s possible to reach the point where the entire court simply blindly follows the opinion of its greatest member. This isn’t what God wants. If it were, He would have put a defendant’s fate in the hands of a single judge.

This mitzvah only applies to the courts. In the Talmud, it is discussed throughout the fourth chapter of tractate Sanhedrin, and specifically on page 36a. It is codified in the Mishneh Torah in Hilchos Sanhedrin chapter 10. It is #283 of the 365 negative mitzvos in the Rambam’s Sefer HaMitzvos.

A Wife's Cry For Help to Find Missing Husband

steven-m-mayerAfter a week of waiting, hoping and praying, Susan Mayer's emotions were frayed to the breaking point. "Somebody has got to see something, say something know something," the Great Neck woman said. "MSteven is out there somewhere and I want him back."Steven Mayer, 65, has not been seen since last Monday. He left for work as he always does, his wife said; but, he never arrived at his job as a scrap metal trader in Huntington.
Foul play is not suspected, said a Nassau county police spokesman. Susan Mayer fears her husband may have suffered a stroke; others believe Mayer may be lost or confused.
"Everybody is growing increasingly worried," said Rabbi Dale Polakoff, a friend. "He's a man who we believe has some issues of disorientation and confusion."
Mayer was diagnosed with a brain tumor over a decade ago — but, his health appeared good the day he disappeared, his wife insisted.
Family and friends have mounted a massive search for the man who once served as president of the Great Neck synagogue.
They have scoured Great Neck, Huntington, Washington Heights, where Mayer grew up and Riverhead, where it appears Mayer placed a cell phone call last week.
Some 2000 people from Brooklyn, New Jersey and upstate New York even joined the search in the Riverhead area Sunday; but they found nothing, not even a trace of Mayer's car- a 2010 Nissan Sentra.
"We're not giving up hope and we won't end the search," said Mark Klinger, Mayer's son-in-law.
Many of the searchers have never even met Mayer, a fact that warms the troubled hearts of his loved ones. They waited for word on his whereabouts at the synagogue Mayer visited almost every day.
"I think he is confused and can't find his way home," Susan Mayer said. "Come home, Steven. Come home to us."

OU TARYAG MITZVOS MITZVA 74. In Absentia: The prohibition against judges hearing testimony if one party is absent

Do not accept a worthless report (Exodus 23:1)
Our verse calls the testimony “shav,” “in vain.” This testimony is worthless because each litigant has the right to hear and respond to his opponent’s case. If testimony is offered in the absence of one of the parties, it is unacceptable, as the present party may be inclined to overstate his case and the absentee is unable to correct him. To avoid this situation, judges are prohibited from hearing from either litigant until everyone has arrived.

Let’s say, for the sake of argument, that a judge is for some reason willing to hear one’s testimony in the absence of the opposing party. In such a case, it would still be prohibited for the present party to offer testimony as the Torah warns us to “keep far from any potentially-false situation” (verse 23:7). Additionally, the Talmud in Makkos (23a) uses our verse to support the idea that one may not accept words of lashon hara (gossip).

The reason for this mitzvah is that God hates falsehood. One litigant testifying in the other’s absence is too tempting a situation; it will invariably lead to some creative embellishments. As we’ve stated, God wants us to keep far away from such situations, so He commanded us not to put ourselves in this position.

This mitzvah applies in all times and places, specifically to the courts. In the Talmud, it is discussed in the tractates of Makkos (23a) and Shevuos (31a). In Shulchan Aruch, it is codified in Choshen Mishpat 17. Not hearing one litigant in the other’s absence is #281 of the 365 negative mitzvos in the Rambam’s Sefer HaMitzvos and #65 of the 194 negative mitzvos that can be fulfilled today as listed in the Chofetz Chaim’s Sefer HaMitzvos HaKatzar.

(In his Commentary on the Mishna, the Rambam lays out thirteen principles that have become accepted at the foundations of belief for Judaism. Once a week, for 13 weeks, we will examine briefly these foundations).
The tenth chapter of the Mishnaic tractate Sanhedrin is called Chelek, meaning a portion as in “All Jews have a portion in the World to Come…” (There are, however, certain exceptions.) In his commentary on the Mishna, the Rambam elaborates on the bases of the Jewish faith. His descriptions of the foundations of Judaism have been summarized in prose and poetry by many hands. Two of these appear in our Siddurim as the list of “Ani Maamins” and as Yigdal.

The first foundation of the Jewish faith is that God created the universe and everything in it. The idea that there’s no God is literally unthinkable to us. He requires nothing in order to exist, but everything else depends on Him. To inform us of this, He has told us in the Torah, “I am Hashem, your God” (Exodus 20:2). Recognizing God is the very first of the “Ten Commandments.”

In the Ani Maamins, this foundation is phrased, “I believe wholeheartedly that God created and rules over all things. He alone has made, makes and will make all works.”

In Yigdal, it is the first line, which reads “Yigdal Elokim chai v'yishtabach; nimtza v'ein eis el m'tziuso” – “May the living God be exalted and praised; He exists unbounded by time.”
