BAIS HAVAAD ON THE PARSHA PARSHAS TAZRIA/HaChodesh

Parshas Hachodesh is the last of the "Four Parshiyos". It is read on the Shabbos before (or on) Rosh Chodesh Nissan and serves to herald the arrival of the Pesach season. In this Parsha we are given the Mitzva of Rosh Chodesh, which is the basis of the Jewish calendar and the observance of the Yomim Tovim.
In earlier generations Rosh Chodesh was established through the testimony of witnesses who would have seen the new moon. In those days it was possible for Rosh Chodesh to be either the thirtieth day or the thirty first day following the start of the previous month. As such, Rosh Chodesh was sometimes observed as a one day festival and sometimes as a two day festival, just like it is today. Since communication and travel in those days was very time consuming the sages decreed that all those who live far from Yerushalayim should keep two days of Yom Tov due to the doubt as to when Rosh Chodesh had been declared. This decree still applies today and is known as Yom Tov Sheini Shel Galuyos.
This week's journal will focus on the halachos pertaining to Yom Tov Sheini Shel Galuyos.


Freedom of Speech?

Reuvain wakes up one morning to find an off-white blotch on his hand. Nervously, he makes his way through the desert to Shimon the Kohen's tent. After carefully studying Reuvain's hand, Shimon pronounces the dreaded word, "tamai". Reuvain is now a metzora. Reuvain slowly trudges back to his tent, bracing himself for a week of confinement outside the Jewish encampment. On his fifth day of confinement, Reuvain receives a surprise visit from Shimon. Shimon explains that he had mistaken the halacha of a white blotch with that of an off-white one, and in fact Reuvain was never a metzora in the first place. After apologizing profusely, he pronounces the word "tahor", and Reuvain is free to go home. But Reuvain's sense of relief is overcome by his feeling of resentment towards Shimon. Couldn't Shimon have double checked the halacha with one of his peers before issuing a ruling of such magnitude?

Fast forward 3300 years... On May 10, 2010, after spending 8 years in prison, Zhao Zuohai was found not guilty of his charges, after a court retried his case. Zuohai was convicted in December of 2002 on manslaughter charges based on the testimony of a single witness, and was sentenced to 29 years in prison. On April 30, 2010, the man Zuohai was convicted of killing was discovered to be alive. The local court acted with lightening speed and only ten days later retried and acquitted Zuohai. He was immediately released from custody. Subsequently, he was awarded compensation of 650,000 yuan (about $96,000) for his wrongful imprisonment.

Although this is an extreme case of judicial misconduct, the fact is that it is possible for (l'havdil) a Dayan or a Kohen to issue an erroneous ruling, whether by mistaking the halacha or by misjudging its application. What compensation, if any, does halacha entitle one who is punished through a mistaken ruling? Is Shimon the Kohen liable in any way for his misjudgment?

Liability for judicial misconduct

The Shulchan Aruch in (Choshen Mishpat, 25; 1-3) states, " a judge who issued a ruling in error... and the judgment cannot be undone, such as if the plaintiff already received money from the defendant and can no longer be located, or if he (in this case, a Rov) erroneously ruled a certain piece of meat as non-kosher, and it was subsequently fed to the dogs... they (the judge or the Rov) are not obligated to pay for these losses since they did not have intention of causing damage[i]"

The Sm"a questions this halacha from the fact that one is often held liable for indirectly causing damage to another even when done unintentionally, as long as he was negligent to some degree. For example, the Shulchan Aruch (Choshen Mishpat, 306; 4-7) discusses a coin inspector that was hired by a merchant to advise him on accepting a certain coin from a prospective buyer as being genuine. The Shulchan Aruch there rules that if he recommended the coin as being genuine and it was later discovered to be counterfeit, he would be responsible to reimburse the merchant for his loss, provided that other professionals in the field would have picked up on the coins nature. This type of damage is referred to as garmi, (lit. causing). Why then should a Dayan or a Rov not be held personally liable for the damage caused by their error in ruling?

The Sm"a explains that a special takana was instituted protecting Dayanim and Rabanim from personal liability of mistaken rulings, for if not, people would refrain from becoming Dayanim or Rabanim. Therefore as long as they acted in good faith they would not be liable for an error in judgment, even if it were due to negligence on their part.

However the Shulchan Aruch does state that if the Dayan or Rov was not adequately knowledgeable to issue rulings in that field but did so any way, he would be liable to pay for the damages. Obviously the above mentioned takana would not extend to such a case.

Getting back to Reuvain the (mistaken) metzora, if it was indeed determined that Shimon the Kohen was not knowledgeable enough to issue rulings regarding tzara'as, would he be made responsible to offer compensation to Reuvain for his unwarranted confinement?

The truth be told, it would be difficult to extend the Shulchan Aruch's ruling to this case. This is because Reuvain did not suffer any financial loss as a result of Shimon's ruling. Although causing one to be wrongfully locked up even in prison would certainly be prohibited, and would be punishable by Hashem, it is not recognized as damage that a Bais Din can seek retribution for. However if Reuvain operated some sort of business in the dessert and can prove that he had a loss of revenue due to his confinement, according to the view of some Poskim, (Ma'asas Binyomin, 27) Shimon would be obligated to reimburse him for this loss.

Other forms of causing damage verbally

The truth is, that delivering improper rulings or advice are not the only instances where one can be liable for the damage caused by his speech. For example, the Shulchan Aruch (Choshen Mishpat, 388; 2) rules that one who discloses the location of his friend's money to a bandit, would be responsible to pay for any money that the bandit ends up taking.

Another example would be the following incident which was brought before the Terumas Hadeshen (307) in the fifteenth century. Rumors had been circulating in the town that the Chazzan had engaged in improper behavior. Because of these rumors, the town committee went and removed him from his post. After a while, though, it became evident that these rumors were totally baseless and were in fact all started by one individual. However by that time the committee had already hired a new Chazzan and thus the former Chazzan was unable to regain his job. The question was, could the slanderer be made responsible to pay the Chazzan for his lost wages? The Terumas Hadeshen ruled that the lost wages were too indirect a damage for Bais Din to impose payment for, however the slanderer had an obligation to reimburse the Chazzan on his own initiative.

The bottom line

And so we see, there really is no such a thing as "freedom of speech". Rather speech is a tool just as sticks and stones are. And although it cannot break any bones it can do much harm. It can cause a Chazzan to lose his job, a merchant to accept counterfeit coins as payment, and even one to be erroneously placed in confinement for a couple of days. And as with any other tool, one can be financially liable for the damage he does with it.

And when we think about it, perhaps this is precisely the lesson the Torah is trying to teach the metzora. As Chazal explain, the affliction of tzara'as came as a punishment for speaking lashon hora. One who speaks lashon hora is not acknowledging speech as a tool which needs caution. After all, there's "freedom of speech". The procedure of tzara'as then shows him the very real ramifications that speech can have. The word "tamai" causes him to get sent away for a week and the word "tahor" causes him to be returned, hopefully a changed person.

[i] It should be noted that the halachos regarding the liability of a Dayan for an erroneous judgment are dependent on many factors and are subject to differing views among the poskim. For this article we have just quoted the words of the Shulchan aruch in order to give the reader a basic idea of the concept, but certainly not to apply it to any specific scenario. It should further be noted that nowadays, virtually all Batai Deinim will require the parties to sign some form of liability wavier before accepting a case, thus virtually eliminating the application of these halachos.

Brooklyn, NY – In an effort to raise both funds and awareness for two Israeli young men who are still being held in a Japanese prison almost three years after unknowingly bringing drugs into the country, Danny Finkleman, producer of the Unity project to benefit Sholom Mordechai Rubashkin, has created another stunning music video, this one featuring two of the top names in Jewish music, superstars Shloime Daskal and Avraham Fried.

The Japan Song is a remake of the Dveykus 2 classic, In A Vinkele, later re-recorded as Tatte by Yaakov Shwekey, featuring all new lyrics by Moti Ilowitz and Moshe Kravitsky in both English and Yiddish. Filmed on two continents, much of the footage for the moving video was filmed at the Chiba Detention Center where the two are being held, only days before Japan was devastated by an earthquake-tsunami combination that claimed the lives of thousands.

The seven minute long video describes the plight of Yoel Zev Goldberg and Yaakov Yosef Greenwald, who are imprisoned in Japan after suitcases that they were carrying for someone else were found to contain drugs. The two, who passed polygraph tests, have long protested their innocence and a third young man, Yosef Bando, has already been released. Produced and directed by Finkelman in conjunction with Teltech Entertainment, The Japan Song is sponsored by the Aaron Teitelbaum Orchestra and Hitech Merchant Services, with musical production by Eli Lishinsky and Nir Graf and cinematography by Mauricio Arenas and De Grupo Films.

While filming in Japan, Daskal and Finkelman had the opportunity to spend thirty minutes with each of the two young men. Meeting them and spending time at the Chiba Detention Center left Daskal and Finkelman feeling even more inspired than ever to do whatever they could to help the pair.

“While I was impressed with the good nature of the Japanese people and their respect for us as Jews,” said Finkelman, “it was heartbreaking to realize that despite the fact that these two young men are imprisoned just a few feet away from each other, they are kept separated and have not spoken to each other for almost three years. While so many of us pray for the welfare of these two young men, it is important that we remember them both with prayers and the donations that are so desperately needed to fund their defense.”

KINUS FOR BOYS IN JAPAN
This morning, Monday, March 28th, 9:00 AM Tokyo time, the trial of one of the boys began. If chas v'shalom a guilty verdict is handed down-there is no chance of appeal. If the boy is convicted , he will get a sentence of hard labor. The minimum amount he will have to serve is 8 months. The people who understand what hard labor means in Japan tell us that if the boys survive physically, they will definitely not survive mentally and will be forever changed. The judge of the 2nd boy is watching these proceedings very carefully and will pass the same judgement –whatever it may be.
 
We are working furiously around the clock to include as many communities as possible in our women-tehillim gathering.
 
 In Chicago there will be a Tehillim kinus at Shaarei Tzedek Mishkan Yair, 2832 West Touhy Avenue this Sunday, April 3, at 8:00 PM.

David Amoyal - David is the owner of the snack stand next to the bus stop. He told everyone to run away and then called the police, and was on the phone with them when the bomb exploded. He suffered injuries to his legs and feet and lower body. He is in moderate condition.
Sasson ben Shulamit - This is the second time Sasson has been injured in a terrorist attack in Jerusalem. He suffered lower body injuries and serious post-traumatic symptoms.
Ad Shapira - Ad is 18 years old and just about to complete high school. She suffered light orthopedic injuries and is in good condition in hospital.
Daniel ben Nurit - Daniel is 13 years old, and suffered lacerations and shrapnel injuries to his lower extremities, and is likely to be released from the hospital before Shabbat.
Netanel ben Shlomit - Netanel is 18 years old and works as a security guard at the bus station. He was injured in the abdomen had surgery. He is now recuperating in the hospital.

Almost everyone knows the four questions that are read in the haggadah during the Passover seders, but for two OU Kosher poskim (halachic authorities) -- Rabbi Yisroel Belsky and Rabbi Hershel Schachter -- multiple other questions are asked of them every year during the Orthodox Union’s Pre-Passover webcast, which this year will take place on Tuesday, April 5 at 2:30 p.m., EDT.

Those who wish to view the webcast should log on 15 minutes prior to that time. The link for the webcast is http://www.ou.org/ouradio/kosher_webcast.

“The webcast, coming a bit more than two weeks before the holiday, will provide ample time for men and women to ask the questions they need to prepare for the holiday and to observe its eight days properly,” declared Rabbi Eliyahu Safran, Vice President of Communications and Marketing at OU Kosher. “As with all other kashrut webcasts, it will be archived so that it can be referred to again and again.”

This year, the OU poskim will focus on questions and answers relating to the proper observance of the seder and interpretation of the haggadah; Pesach away from home and in the office; and inedibles -- use of medicine, toothpaste, cleansers and disposables.

Rabbi Safran points out that the Rabbis Belsky and Schachter’s popular webcasts are part of OU Kosher’s continuing and ever-growing educational outreach to the community, which includes:

• “OU Kosher Coming to Schools and Communities” program;

• The highly informative and entertaining Kosher Tidbits postings on OU Radio (www.oukosher.org/index.php/learn/koshertidbits), which most recently include “Vegan Restaurants: The Problems that Can Sprout Up,” with Rabbi Dov Schreier; “Kosher Cheese – Not Made with Ease,” with Rabbi Avrohom Gordimer; “Is There Something Fishy about Meat,” with Rabbi Eliyahu W. Ferrell; and

• OU Kosher educational DVDs. The recently released “What's Wrong With this Chicken?” featuring Rabbi Belsky, is the sixth of the OU Kosher DVDs, being used extensively in homes, yeshivas, schools, synagogues and youth groups.

“We are thankful to everyone who helped make this happen,” said Chaim Marcus who wrote and produced the video. “There are close to 50 people who appear in the video and most of the shooting happened in middle of the night”.

The video was shot on the Red One MX –a camera with incredible picture quality used mainly for feature films- and can be viewed in HD at 1080p.

“If this video doesn’t make you smile and dance, check yourself for a pulse” joked Bentzion Marcus, who produced and arranged the album -“you can file this one under the pure joy category,” he added.

The ever popular California based band is on its third printing of the new CD entitled “Chasing Prophecy”, as the new CD continues to be a best seller across the country and locally at stores like Eichlers in Flatbush, Tuvia’s in Monsey, Mostly Music in Boro Park, Judaica Plus in the Five Towns and Hamafitz and Judaica World in Crown Heights.

TEHILLIM – Meshulach With 14 Children Struck By Vehicle; Critically Injured

(Sunday, March 20th, 2011)
Lakewood, NJ – Please be Mispallel for Pinchos Ben Sarah Esther, a 41-year-old Meshulach from Eretz Yisroel, who was critically injured after being struck by a vehicle in Lakewood on Purim night.
The accident happened after midnight on Motzei Shabbos, when he was struck by a vehicle while crossing 14th Street. Lakewood Hatzolah Paramedics were rushed to the scene, and transported him to the Jersey Shore Trauma Center, where he is listed in critical condition, with a serious head injury.
There was no foul play involved in this incident, and is just a very tragic accident.
The Meshulach reportedly has a wife and 14 children in Eretz Yisroel.
