As you might have already heard, lawyers for Sholom Rubashkin -- Paul Clement and Nathan Lewin -- recently filed a cert petition to the Supreme Court asking the court to hear the case.
This past Friday, an excellent Op-Ed was co-authored by two prominent professors, Alan Dershowitz and Ronald Rotunda. you can see it by clicking here. Please forward it to all your friends and post the link on your facebook page!
Also, 50 congressmen have thus far written to the Attorney General urging for an investigation into prosecutorial misconduct and Sholom's draconian 27-year sentence.

Examine the discipline of your endurance. Endurance must be directed toward productive goals and expressed in a constructive manner. Is my endurance and determination focused to help cultivate good habits and break bad ones? Or is it the other way around? Does my endurance come from strength or weakness? Does it come out of deep conviction or out of defensiveness? Am I ever tenacious out of stubbornness and an unwillingness to acknowledge errors? Am I invested in certain decisions and not prepared to review them? Do I use my endurance against itself by being tenacious in my lack of determination?
Exercise for the day: Break one bad habit today.

Week Four - Netzach
Endurance and ambition is a combination of determination and tenacity. It is a balance of patience, persistence and guts. Endurance is also being reliable and accountable, which establishes security and commitment. Without endurance, any good endeavor or intention has no chance of success.
Endurance means to be alive, to be driven by what counts. It is the readiness to fight for what you believe, to go all the way. Without such commitment any undertaking remains flat and empty. It is an energy which comes from within and stops at nothing to achieve its goals. This, of course, requires that endurance be closely examined to ensure that it is used in a healthy and productive manner.
Ask yourself: How committed am I to my values? How much would I fight for them? Am I easily swayed? What price am I ready to pay for my beliefs? Is there any truth for which I would be ready to give my life?
Effective endurance needs to encompass the following seven ingredients: love, discipline, compassion, endurance, humility, bonding and dignity. The problems people have with endurance and commitment are due to a lack of one or more of these seven components.

Examine the dignity of your compassion. For compassion to be complete (and enhance the other six aspects of compassion) it must recognize and appreciate individual sovereignty. It should boost self-esteem and cultivate human dignity. Both your own dignity and the dignity of the one benefiting from your compassion. Is my compassion expressed in a dignified manner? Do I manifest and emphasize majesty in my compassion? Does it elicit dignity in others? Do I recognize the fact that when I experience compassion as dignified it will reflect reciprocally in the one who receives compassion?
Exercise for the day: Rather than just giving them charity help them help themselves in a fashion that strengthens their dignity.

Surprising Risk for Toddlers on Playground Slides

Last spring, Katie Dickman of Dunkirk, Md., was at the playground with her 18-month-old toddler, Hannah, when the little girl asked to ride down a twisting slide. Ms. Dickman accompanied her daughter, carefully keeping the child on her lap as they coasted to the bottom.
But without warning, Hannah’s sneaker caught on the side of the slide. Although Ms. Dickman grabbed the leg and unstuck her daughter’s foot, by the time they reached the ground, the girl was whimpering and could not walk. A doctor’s visit later revealed a fractured tibia.
“My wife was just trying to keep Hannah extra safe and make sure she didn’t fall,” said Hannah’s father, Jed Dickman. “She felt very guilty about it.”
As the Dickmans soon learned, such injuries are surprisingly common. Although nobody keeps national statistics, orthopedic specialists say they treat a number of toddlers and young children each year with broken legs as a result of riding down the slide on a parent’s lap. A study at Winthrop University Hospital in Mineola, N.Y., found that nearly 14 percent of pediatric leg fractures over an 11-month period involved toddlers riding down the slide with a parent.
Dr. Edward Holt, the orthopedic surgeon at Anne Arundel Medical Center in Annapolis who treated Hannah’s injury last April, said that just two weeks ago he treated a 4-year-old boy who had been injured going down the slide with his father.
“This fracture is entirely preventable,” said Dr. Holt, who has created a warning poster for local pediatrician offices and a You Tube video alerting parents to the hazard.
This may be one of those counterintuitive cases when a child is safer by himself. If a foot gets caught while the child is sliding alone, he can just stop moving or twist around until it comes free. But when a child is sitting in an adult lap, the force of the adult’s weight behind him ends up breaking his leg.
The injury is typically treated with a cast from the foot to above the knee; the good news is that no surgery or resetting is needed. The child wears the cast for four to six weeks and heals without any lasting complications.
But the damage is not merely physical. “The parents are always crushed that they broke their kid’s leg and are baffled as to why nobody ever told them this could happen,” Dr. Holt said. “Sometimes one parent is angry at the other parent because that parent caused the child’s fracture. It has some real consequences to families, and I hate to see it happen.”
The Mineola study was done by Dr. John Gaffney, a pediatric orthopedic specialist at Winthrop, after he had treated a rash of playground slide fractures. The hospital’s data indicated that every sliding fracture involved a child younger than 3 riding in an adult’s lap. The fracture might not be immediately obvious, but typically the child appeared to be in pain and could not put weight on the leg.
Dr. Gaffney said he has treated three playground fractures in the last month for children sliding with a grandparent, a parent and a baby sitter.
“As soon as the weather gets warm, this starts to happen,” he said. “It’s so common, but parents say: ‘How did I not know about this? I thought it was doing something good for my child by having them sit on my lap.’ ”
Andy Dworkin, a former journalist who is now a medical student in Portland, Ore., said his son Felix, then 18 months, was playing with a toddler friend at an elementary school where they were drawn to a blue slide. Felix rode down first, on the lap of his mother, but his rubber-soled shoe caught on the slide and he started to scream when he got off the slide.
Another mother, at the top of the slide with her own 17-month-old, quickly slid down with her son to try to help. But soon that little boy was crying as well. At the emergency room, both boys were found to have fractures, and they were fitted with orange and blue casts.
“I was surprised at how easy it was for a young child to break their leg on a playground,” said Mr. Dworkin, who wrote about the experience for his hometown paper, The Oregonian. “I was even more surprised how nonchalant the hospital staff was about what was happening. They said they see this all the time.”
Both boys had full recoveries. Felix, now 3 ½, doesn’t remember the accident, but will now go down small slides only and remains cautious around large twisting slides, said Mr. Dworkin.
Dr. Holt said he did not want to discourage parents from taking their children to the playground or even playing on slides, but did want to spread the word about the risks of sliding with a child on your lap.
To prevent the injury, the best solution is to allow a child to slide by himself, with supervision and instructions on how to play safely. Young children can be placed on the slide at the halfway point with a parent standing next to the slide. At the very least, parents should remove a child’s shoes before riding down the slide with the child on their laps, and make sure the child’s legs don’t touch the sides or sliding surface.
“I’m not saying we need to make the entire world out of rubber and insulate kids,” he said. “But this is something that is so totally predictable and preventable. That’s why I want to get the word out this one could go away.”

As many of you know, I have been living in the apartment under an elderly Jewish man, Mr. Seymour Jaffe a''h, for over 15 years. I became PowerOfAttorney for him a couple of years ago. He was very isolated and knew only me, his neighbor.
Recently, I have had to use that POA to put him in the hospital and then to the nursing home. I have been taking care of both his medical and financial decisions for about 7 weeks now.
He passed away last night. I arranged a grave side funeral for him at Waldheim at 2pm Erev Shabbat. (Through Weinstein on Skokie Blvd.)
He had no family here, had no siblings, never married and no children. There will be only me and a trusted CareGiver to see him off as he journeys to the next world. May he rest in only peace.
Should there be ANY JEWISH MAN available tomorrow afternoon.......we are up to SIX men for a minyan......and I would love to have a minyan if possible. Call Weinstein on Skokie Blvd and ask where to find us at Waldheim.
As for my time.....I am not finished yet. I move into another new job...Executor of his Will. I SO SO SO apologize for not being available to my friends, clients!, and other mitzvah opportunities in the last weeks. Please forgive me. Things will slow down soon.

For compassion to be fully realized, it needs bonding. It requires creating a channel between giver and receiver. A mutuality that extends beyond the moment of need. A bond that continues to live on. That is the most gratifying result of true compassion. Do you bond with the one you have compassion for, or do you remain apart? Does your interaction achieve anything beyond a single act of sympathy?
Exercise for the day: Ensure that something eternal is built as a result of your compassion.

Compassion must include humility for it not to be condescending and pretentious. Hod is recognizing that my ability to be compassionate and giving does not make me better than the recipient; it is the acknowledgement and appreciation that by creating one who needs compassion G-d gave me the gift of being able to bestow compassion. Thus there is no place for haughtiness in compassion. Do I feel superior because I am compassionate? Do I look down at those that need my compassion? Am I humble and thankful to G-d for giving me the ability to have compassion for others?
Exercise for the day: Express compassion in an anonymous fashion, not taking any personal credit.

Exercise for the day: In middle of the busy day take a moment and call someone that needs a compassionate word. Defend someone who is in need of sympathy even if it's not a popular position.

YWN Avreich Imprisoned in Holland Heads for Home
The 28-year-old avreich imprisoned in Holland for ‘forging’ his passport has been released by authorities. He arrived back in Eretz Yisrael on Tuesday, 2 Iyar 5772, about two weeks after his ordeal began.
The court ruled that despite recent similar cases in which passports were modified, and those defendants spent four months in jail, the court will be satisfied with time served and the case was dismissed. The court realized that despite the severity of the avreich’s actions, he was naïve and innocent, and his intentions were not of malicious intent.
Defense attorney Mordechai Tzivin praised the court and authorities, citing his client was treated very fairly and his conditions were above reproach. He also issued a warning to Israelis to refrain from making any changes whatsoever to official documents for doing so may make them suspects of terrorism or hostile activity against another nation.

Examine the compassion of compassion. The expression of compassion and its intensity. True compassion is limitless. It is not an extension of your needs and defined by your limited perspective. Compassion for another is achieved by having a selfless attitude, rising above yourself and placing yourself in the other person's situation and experience. Am I prepared and able to do that? ~ INTRODUCTION ~ Halachos of Kiruv Of the many revolutions that have plagued world history, we can say that there is one that only brings smiles to concerned Jews all over the world, and that is the Kiruv movement. It is told that two secular Jews from a Kibbutz once came to the Kollel of theChazon Ish, to learn about their heritage and return to their roots. Upon seeing this, the Chazon Ish told his students that at this point in time there are only few people returning to Torah observance, but there will come a time when they will be flocking to return to Hashem by the hundreds and the thousands. We are fortunate to witness this prophecy be fulfilled. Kiruv is not only a praiseworthy endeavor, it is actually a Mitzvah. The Rambam in Sefer Hanitzvos (Asin 4) explains that theMitzvah to love Hashem includes the obligation to reach out to others and encourage them to believe in and serve their creator. The concern that others should know about Hashem is a direct result of our love for him. He quotes the Sifri on the Possuk - ve'ahavta es Hashem, make Hashem be beloved in the world like Avrabam Avinu did out of his great love and understanding of Hashem. From a Bein Adam L'chaveiro aspect, the greatest gift that one can give his fellow Jew, is a sense of direction in life, and the help in finding his true self after generations of alienation. Kiruv - closeness, is not only the experience of becoming closer to Hashem, but also the concept of becoming closer and more in touch with one's real self and one's real goals and aspiration. One who returns to the Torah is actually like a child freshly born, and the one instrumental in enabling his return is regarded as having fathered him (see Sanhedrin 19B). An obvious prerequisite for bringing others back to the Torah is a boundless love for all of Jewry, as the catalyst for impressing ideas upon others is always a genuine concern for them. Derashos Haran (9) writes that anyone wishing to correct a person who has done wrong should do this in two steps. First, he must let him know what he did wrong. Second, he must let him know that despite his wrongdoings he is beloved by his friend and remains in his good graces. The Mishna in Avos (1, 12) tells us, Be from the pupils of Aharon, love and seek peace, love all creations, and bring them closer to the Torah. The author of this Mishna is Hillel Hazakein, best known for his humility and patience. Even when provoked very strongly by two mischievous characters who harassed him with ridiculous questions on Erev Shabbos, he kept his cool and didn't get upset. It follows that he is the one to teach us that bringing others closer to the Torah must be preceded by a love for peace and for all of creations. A special Tefillah has been composed, and it can serve as an excellent substitute for those who aren't involved in active Kiruv. It reads, "Master of the world, may it be your will that you dig a special tunnel under your Kisey Hakovod, to enable all those who are astray to return to you. The parsha deals with the eighth day of the dedication of the Mishkan. In general it can be stated that the eighth day after any event can be a time of challenge. The eighth day of life is the day of circumcision of male Jewish children. The eighth day – the day after the week of rejoicing of a young newly married couple - was and is the day when real married life with all of its joys and challenges begins.

"Aaron's sons, Nadav and Avihu, each took his fire pan, placed fire on it and then incense. They offered before God a strange fire that God had not instructed them. Fire came forth from before God and consumed them; and they died before God." (Lev. 10:1-2)

"You shall sanctify yourselves and you shall be holy, for I am holy; you shall not contaminate yourselves" (Vayikra 11:44)
The Torah concludes its elaboration of the forbidden foods at the end of this week's portion by commanding us to be holy. The juxtaposition of the two ordinances, "you shall sanctify yourselves" and "you shall not contaminate yourselves" indicates that eating foods that are permitted by Torah is a precondition for holiness.
Holiness in our eating is not only what we eat, but how and how much we eat.

16th Day of the OmerFor compassion to be effective and healthy it needs to be disciplined and focused. It requires discretion both to whom you express compassion, and in the measure of the compassion itself. It is recognizing when compassion should be expressed and when it should be withheld or limited. Discipline in compassion is knowing that being truly compassionate sometimes requires withholding compassion. Because compassion is not an expression of the bestower's needs but a response to the recipient's needs. Am I more compassionate with strangers than with close ones? If yes, why? Is the compassion coming from guilt?

A 13-year-old chareidi youth was attacked by Arabs in the Shar Shechem (Nablus Gate) of Jerusalem’s Old City on Friday night. He was hit by a marble fired with a slingshot. His injury is reported to be light-to-moderate. The victim was hospitalized. Police are investigating.
The young Breslov chossid explained that a group of 8-to-10-year-old Arabs surrounded him and when he tried to flee he was struck in the eye with the stone. He was returning from Shabbos tefilos at the Kosel when he was attacked.
The young victim underwent surgery to save his eye in Hadassah Ein Kerem Hospital but doctors explain he is still in danger of losing the injured eye.
His name for Tehillim is Nosson ben Sarah b’soch kol cholei am yisrael.

Week three - Tiferet
Tiferet - compassion - blends and harmonizes the free outpouring love of chesed with the discipline of gevurah. Tiferet possesses this power by introducing a third dimension - the dimension of truth, which is neither love or discipline and therefore can integrate the two.
Truth is accessed through selflessness: rising above your ego and your predispositions, enables you to realize truth. A clear and objective picture of yours and others needs. The imbalance of love and discipline (and for that matter, any distortion) is a result of a subjective, hence limited perspective; introducing truth, by suspending personal prejudices, allows you to express your feelings (including the synthesis of chesed and gevurah) in the healthiest manner.
This quality gives tiferet its name, which means beauty: it blends the differing colors of love and discipline, and this harmony makes it beautiful. For tiferet to be complete it needs the inclusion of the following seven facets: love of compassion, discipline of compassion, compassion of compassion, endurance of compassion, humility of compassion, bonding of compassion and sovereignty of compassion.

Healthy discipline should bolster self-esteem and help elicit the best in a person; cultivating his sovereignty. And that does not compromise the discipline; on the contrary it fosters and enhances it. Does my discipline cripple the human spirit; does it weaken or strengthen me and others?
Exercise for the day: When disciplining your child or student foster his self-respect.

About This Crime:
Four victims, ages 4 through 12, were walking to school between 8:30-8:40 A.M., March 26, 2012, in the 2100 block of West Jarvis. A white older model van with tinted windows approached them at 7232 N. Ridge, which contained two male Hispanics. The driver was about 30-40 years old, with a medium complexion, heavyset, with black hair styled in a Mohawk fashion (short on the sides, longer on top and combed toward the center), with a braided goatee, wearing a black T-shirt, and told the victims, "Get in the car!" The children kept walking and the van continued to follow them south on Ridge. The
passenger, was about 30-35 years old, dark complexion, no facial hair, wearing a black hooded sweatshirt, had a diamond stud earring in his left ear and a teardrop tattoo under his left eye, also told them, "Get in the car or I'm going to get you in!” The driver had a Spanish accent but the passenger did not. The offenders fled south on Ridge when they spotted a Chicago Police patrol car in the area. The children were not hurt.

This is a commendable custom, since one will /thereby/ be permitted to move the table, should he need to do so. If the /Shabbos/ light is an oil /lamp/, however, one should be extremely careful to move the table gently, so as not to cause the oil to move closer to, or farther from, the wick. See the P.Mg., who is inclined to the opinion that after the /Shabbos/ lights have gone out, one is not permitted to move the table while the lamp is upon it, since one is able to shake it off first. This applies only to where the /lamp or candleholder/ is of metal, where no loss of money will result from shaking it off /the table/.

For discipline to be effective it must be coupled with commitment and bonding. Both in disciplining yourself and others there has to be a sense that the discipline is important for developing a stronger bond. Not that I discipline you, but that we are doing it together for our mutual benefit.
Exercise for the day: Demonstrate to your child or student how your bonding with each other is an essential ingredient in discipline and growth.

Love comes from recognizing one's merits and positive qualities (discipline channels and directs those strengths and weeds out the negative). Compassion is unconditional love. It is love just for the sake of love, not considering the others position. Tiferet is a result of total selflessness in the eyes of G-d. You love for no reason; you love because you are a refelection of G-d.
Does my discipline have this element of compassion?
Exercise for the day: Be compassionate to someone you have reproached.

Update on the Medical Condition of the Rosh Hayeshiva
Boruch Hashem on Erev Pesach the Rosh Hayeshiva was moved to a
Rehabilitation Center, as the next positive step of recovery. Over Yom Tov
the Rosh Hayeshiva felt better, stronger and everyone was pleased with the
progress. Shortly after Yom Tov concluded the Rosh Hayeshiva was taken to
a local hospital due to a complication. At this time Rav Belsky shlita is
in Intensive Care but stable. We clearly see that we need a lot of siyata
d'shmaya throughout the process and so we need everyone's help.
Please continue to daven for Chaim Yisroel ben Chana Tzirel at every opportunity
so that the Rosh Hayeshiva has a speedy and complete recovery.

The rav of the Zichron Moshe Shteibelach HaGaon HaRav Aaron Fisher Shlita collapsed and was transported to a local hospital earlier today, Tuesday, 25 Nissan 5772. It appears the rav’s condition is quite serious.
The rav is a son of Ravaad of the Badatz Eida Chareidis, Hagon HaRav Yisrael Yaakov Fisher ZT”L.

Examine the discipline factor of discipline. Is my discipline disciplined or is it excessive. Do I have enough discipline in my life and in my interactions? Am I organized? Is my time used efficiently? Why do I have problems with discipline and what can I do to enhance it? Do I take time each day for personal accounting of my schedule and accomplishments? Week Two - Gevurah
If love (chesed) is the bedrock of human expression, discipline (gevurah) is the channels through which we express love. It gives our life and love direction and focus. Take a laser beam: Its potency lies in the focus and concentration of light in one direction rather than fragmented light beams dispersed in all different directions.
Gevurah - discipline and measure - concentrates and directs our efforts, our love in the proper directions. Another aspect of gevurah is - respect and awe. Healthy love requires respect for the one you love.

FOR IMMEDIATE RELEASE - April 14, 2012 - Dole Fresh Vegetables is voluntarily recalling 756 cases of DOLE® Seven Lettuces salad with Use-by Date of April 11, 2012, UPC code 71430 01057 and Product Codes 0577N089112A and 0577N089112B, due to a possible health risk from Salmonella. Dole Fresh Vegetables is coordinating closely with regulatory officials. No illnesses have been reported in association with the recall.
The Product Code and Use-by Date are in the upper right-hand corner of the package; the UPC code is on the back of the package, below the barcode. The salads were distributed in fifteen U.S. states (Alabama, Florida, Illinois, Indiana, Maryland, Massachusetts, Michigan, Mississippi, New York, North Carolina, Ohio, Pennsylvania, Tennessee, Virginia, and Wisconsin).
No illnesses have been reported in association with the recall. This precautionary recall notification is being issued due to an isolated instance in which a sample of Seven Lettuces salad yielded a positive result for Salmonella in a random sample test collected and conducted by the State of New York.
No other Dole salads are included in the recall. Only the specific Product Codes, UPC codes and April 11, 2012 Use-by-Date of Seven Lettuces salads identified above are included in the recall. Consumers who have any remaining product with these Product Codes should not consume it, but rather discard it. Retailers and consumers with questions may call the Dole Food Company Consumer Response Center at (800) 356-3111, which is open 8:00 am to 3:00 pm (PDT) Monday - Friday.
Retailers should check their inventories and store shelves to confirm that none of the product is mistakenly present or available for purchase by consumers or in warehouse inventories. Dole Fresh Vegetables customer service representatives are already contacting retailers and are in the process of confirming that the recalled product is not in the stream of commerce.
Salmonella is an organism that can cause foodborne illness in a person who eats a food item contaminated with it. Symptoms of infection may experience fever and gastrointestinal symptoms such as nausea, diarrhea, vomiting or abdominal pain. The illness primarily impacts young children, frail and elderly people and those with weakened immune systems. Most healthy adults and children rarely become seriously ill.

Please daven for AHARON (ALEXANDER) LEON ben NATALYA, who was flown from Kiev to Tel Aviv Wednesday chol hamoed. Aaron was beaten almost to death (probably by neo-Nazis) on motzei Shabbos after leaving his second Seder in Kiev at about 00:30 in the morning. While Aaron remains comatose and in critical condition, he was stable enough to permit his transfer from a Kiev hospital to Ichilov Hospital in Tel Aviv. Zaka was involved in the airlift. Please daven for a refuah sheleima for AHARON LEON ben NATALYA.

The name of the prayer means “May He remember” (“He” being God and “Yizkor” being the first word of the prayer). Not only do many who recite the prayer find it to be a moving, emotional experience, it also has the power to elevate spiritually the souls of the departed.
Yizkor is predicated on the Jewish concept of the immortality of the soul. Although the deceased can no longer perform mitzvos, they can benefit from prayers, acts of charity, and other good deeds that their survivors perform on their behalf. Yizkor is an excellent time for personal reflection and to commit to particular actions or general self-improvement as a source of merit for the departed.
The Yizkor prayer is typically preceded by an appeal in the synagogue. This is not a mercenary attempt to extort funds from a captive audience; committing to give charity is an inherent part of the Yizkor experience. If one says the prayer by himself at home, he should nevertheless commit to donate to an appropriate charity in the deceased’s memory.
