Q: As an administrator of a Mosad that is experiencing financial difficulties, I would like to know the extent of my obligation to ensure that the employees are paid on time. A: The following is a summary of the laws of Bal Talin, the prohibition of delaying a worker's wages, as well as some exceptions that apply, and their parameters. Bal Talin obligates an employer to pay his worker within the night following his work for a day laborer, or the day following the work of a night laborer. Once this time has passed, Bal Talin is not further transgressed, but the Rabbinic prohibition of Bal Tash’he applies whenever one tells a creditor to go and return later for his payment. This prohibition however, is more lenient than Bal Talin because it doesn’t apply to one who isn’t paying because he is too preoccupied to do so. The Tashbetz (1,64) writes that if the original agreement was to pay the worker, not on a daily basis, but on a weekly or monthly basis, Bal Talin only applies on the day that the payment is due. The Gemara (Bava Metziah, 111) says that there is no Bal Talin if the worker knew before he started working that his wages would be delayed to the day of the market or to after the employer does his accounting. Bal Tash'he however applies after the anticipated date of payment. R' Elyashiv1 adds that an institution that is notorious for delaying payments is not subject to Bal Talin for this reason. Shevet Halevi (7, 233:1) however says that one should follow the stringent opinion of the Meiri that Bal Tash'he applies right away, even if the worker anticipates delayed payment.

7:41 am Shlomit Kreigman HY"D - Shlomit bat Na'ama Rivka Shlomit Kreigman (24) HY"D has died from her wounds from the terror attack in Beit Horon according to Hadassah hospital. She was brought into the hospital in critical condition and died on Tuesday morning. Shlomit was from the community of Shadmot Michola in the Bikat HaYarden and for the past year, Shlomit was living with her grandparents' home in Beit Horon. She was previously the head counselor/manager ("Komanarit") for Beit Horon's Bnei Akiva branch while she was serving in Sherut Leumi (National Service). Shlomit's grandparents were among the founders of Beit Horon.

The Mashgiach of the Mir Yerushalayim, Hagaon HaRav Aaron Chodosh Shlita, was taken to the hospital on Monday night after not felling well. Hatzoloh and Magen David Adom were called to the home of the Mashgiach in the Bais Yisroel neighborhood of Yerushalayim, after the Mashgiach complained of chest pains and shortness of breath. YWN regrets to inform you of the Petira of HaGaon HaRav Refoel Shmuelevitz ZT”L, 78, one of the Mir Yerushalayim Roshei Yeshiva. Earlier today, a false notification was made by officials in Shaare Zedek Hospital in Yerushalayim. Tefillos intensified at Batei Midrashim around the world, until his Petira just a few moments ago. The Torah giant was rushed to the hospital a number of days ago after his condition deteriorated. Rav Refoel Shmulevitz was diagnosed with ALS approximately four years ago, and was given two to four years to live. He lost the ability to talk clearly and was confined to a wheelchair. Not long after, YWN reported that a new experimental treatment for MS (multiple sclerosis) and ALS (amyotrophic lateral sclerosis) was giving Rav Rafael Shmulevitz hope. The rav’s family was summoned to his bedside on Monday morning 8 Shevat as his condition took a turn for the worse. Rav Refoel was born in 1937 in Poland to his parents a son of Hagon HaRav Chaim Shmulevitz ZATZAL, the Rosh Yeshiva of Yeshivas Mir Yerushalayim and his mother Rebbitzen Chana Leah (Finkel). She was the daughter of Hagon HaRav Eliezer Yehuda Finkel, who was the Rosh Yeshiva of Yeshiva Mir. He was a grandson of the Alter of Nevardok and the Alter of Slabodka. In 1962, Rav Refoel married the daughter of Hagon HaRav Avrohom Farbshtein, the Rosh Yeshiva of Chevron. He initially served as a R”M in Chevron Yeshiva, until his father was Niftar, at which point he served as one of the Roshei Yeshiva in the Mir. Rav Refoel was one of the most brilliant Torah minds of the generation. His sons are Rav Yaakov, a Rosh Yeshiva in the Mir, Rav Bentzion, Rav Eliezer, Rav Nosson Tzvi and Rav Yechezkel. His daughters are married to Rav Avrohom Segal, Rav Yosef Pines, Rav Shmuel Wolf, Rav Avrohom Shapira. His brothers are Hagon HaRav Avrohom Tzvi, and Hagon HaRav Meir. His brothers in law are Hagon HaRav Yitzchok Ezrachi and Hagon HaRav Yisroel Meir Weiss. The Levaya is scheduled for Tuesday morning at 11:30AM at the Mir Yerushalayim. TRAGEDY IN PASSAIC: Body of Devorah Stubin a”h Found January 16, 2016 7:04 pm devorah stubin[Update below.] It is with great sadness that we report the passing of Devorah Stubin a”h, who had been missing since last week. Police found Devorah’s car in the Passaic River in Wallington, NJ. Hundreds of Yidden gathered today, on Shabbos, in Maywood, New Jersey, to help search for the missing 22-year-old from Passaic. Despite the fact that it was Shabbos, the volunteers – including members of Hatzolah, Chaverim and Shomrim – were instructed to do anything necessary, as it was deemed a situation of pikuach nefesh. Devorah was last seen in Maywood Township late Thursday night after she left home to pick up her brother. She was driving a gray Mitsubishi Galant with New Jersey license plate number K40FPH, and police confirm that they discovered the car today in the Passaic River. The exact nature of what occurred is not yet clear. A Hatzolah member tells Matzav.com that the vehicle was found at approximately 4:00 p.m. this afternoon. Police say that Devorah had been stopped by a police officer on East Central Avenue for driving without her headlights on. After she told the officer she was lost, the officer gave her directions and followed her up the hill where she was last seen making a right on Summit Street. The police checked her EZ-Pass, which had not been used. Sheriff Michael Saudino, of the Bergen County Sheriff’s Department, said that she also had not used her credit card or her ATM card. Officials knew something was amiss. Today, the heroic work of the Hatzolah, Chaverim and Shomrim volunteers led to the discovery of the car. After a while, her brother saw that she isn’t coming. Her mother called her. She was crying and said that she is lost and a cop stopped her because her headlights were off. The mother said that she will go pick up her brother and instructed her to use her GPS to get home. After a while, her mother called again and the phone was shut. “Passaic Hatzolah called Monsey Chaverim on Friday afternoon and said that they never had such a search and they need help. Chaverim mobilized units and spent the entire Shabbos searching alongside Passaic Hatzolah and Shomrim from Boro Park and Williamsburg along with many members of Lakewood Chaverim. “At around 3:45 Shabbos afternoon, a few Monsey members called in that they see a broken gate next to the river. Police were dispatched right away and confirmed that the car in there. They pulled out the car already and identified the body, and prepared it for transfer to the Passaic Chevrah Kadishah. There are cameras on the property that are being reviewed.”

Devorah Stubin was last seen at 8:45 PM, Thursday night. She is wearing a black sweater and skirt, pink wool coat, rainbow sneakers, and gold-rim glasses. he is 5 foot 2 inches in height, and weighs 110 pounds. She has dark brown hair. She was last seen when stopped by police in Maywood, NJ and stated she was lost. The officer reportedly gave her directions to get back on the Garden State Parkway. The car she is driving is a 1998 silver Mitsubishi Galant, with NJ Pate number K4O FPH. Identifying marks on Vehicle: Antenna taped with orange strip and grey tape. THE BAIS HAVAAD HALACHA JOURNAL: Volume 5776 Issue XIV Va'eira HOW TO AVOID CONFUSION IN AGREEMENTS The Letter of Understanding. By Rabbi Yehoshua Wolfe


A letter of understanding is a formal text, commonly used to confirm the details of a verbal agreement. The letter of understanding, also known as a letter of intent, can be used in asset purchase agreements, joint venture agreements, lease agreements, and other cases. What is the halacha when the two parties do not agree on the letter of understanding? Can the terms of the letter be enforced? In one case, Reuvain verbally contracted to lease a house to Shimon, in exchange for a sum of money. Reuvain and Shimon also casually agreed upon terms dealing with common landlord-tenant issues. The terms of their verbal agreement were never put into writing. After consulting with professional legal counsel, Shimon sent a letter of understanding in good faith to Reuvain. The letter laid out all of the terms that they had verbally agreed upon. The conclusion of the letter stated that if Reuvain did not respond to the letter prior to the commencement of the lease, it would be assumed that Reuvain consents to all of the terms in the letter of understanding. Reuvain received the letter, and he did not respond. During the course of Shimon’s tenancy, a disagreement arose between the two parties. Reuvain claimed that he was not obligated to shovel snow, as per the terms of their agreement. Shimon disagreed, and argued that the letter of understanding explicitly placed this responsibility on Reuvain. If Reuvain failed to reply to the letter of understanding, does this mean that he automatically consented to it, and is therefore, bound to its terms? Can Shimon use the letter of understanding against Reuvain in bais din?

BS"D Rav Chaim Shlomo ben Tzaita Leah . . .. doctors have confirmed that the rosh yeshiva (of Ponvezh in Bnei Brak) is hospitalized in serious condition in the intensive care unit at Sheba hospital in Tel Hashomer and that there has been no change in his condition in recent hours. The doctors stressed that Rav Leibowitz is still in extremely critical condition and undergoing antibiotic treatment. The physicians stated that the next 24 hours are “critical.” Tonight, a late-night atzeres tefillah is scheduled to be held at Ponvezh Yeshiva in Bnei Brak, with the recital of the Shlosh Esrei Middos led by the roshei yeshiva, Rav Gershon Edelstein and Rav Berel Povarsky. 3 days until January 15, 2016 Yeshaya ben Chava. He is the Rav of Rochester, NY and is battling Lukemia. 8 weeks, until March 12, 2016. Shmaryahu Yosef Chaim ben Pesha Miriam B’chasdei Hashem HaGaon HaRav Chaim Kanievsky Shlita was released from Mayanei HaYeshua Hospital on Tuesday morning 2 Shevat. It is reported that immediately upon entering his home, the Posek Hador headed for his shtender to resume his unparalleled Hasmadah and Limud Hatorh. The Posek Hador was admitted for observation on motzei Shabbos and subsequently diagnosed with a respiratory infection which required treatment over a number of days. While Rav Chaim is home he needs to rest and his gabbaim report he will not receive people seeking his Brachos in the coming days.
