True Life

BS'D

Distress in life often doesn't come from circumstances—it comes from disconnection.

When we try to live outside the flow of Hashem's will, we drift from our own essence. We begin to live a version of life that isn't really ours. We lose touch with the higher self we're here to become.

It's humbling to realize that at the root of much of our dissatisfaction is our ego—our desire to be in control. But the soul doesn't crave control. The soul craves alignment. And that's what Torah and mitzvot provide.

The Jewish people are likened to the Five Books of the Torah. When we detach from Torah—called the Etz Chayim, the Tree of Life—we detach from our true source of vitality.

You were never meant to figure everything out alone. The tools you were given—tefillah, learning, introspection, surrender—help realign you with the life you're meant to live.

And when you do that, you don't just exist. You truly live.

"
Emuna isn't passive. It's a courageous choice to lean in when every part of you just wants to pull away.
— Orit Esther Riter

If a Doctor Delegates Responsibility, Who is Liable For a Misguided Treatment?

Question: It is common for doctors to diagnose patients and then to have their nurses perform the actual procedure. If a doctor's negligence leads to a misdiagnosis, and the nurse is the one who actually does the procedure that injures the patient, who is responsible?

CLICK BELOW TO WATCH THE VIDEO

Rav Yitzchak Grossman

Answer:  Rav Zalman Nechemiah Goldberg says that it is clear that the doctor who made the misdiagnosis would bear responsibility in a case like this because he was the decision-maker who indirectly caused the damage. He discusses whether the damage caused by the doctor would be classified as "garmi" (an indirect form of damage that one is liable for in dinei odom), or "grama" (an indirect form of damage that one is only liable for in dinei shomayim). In any case, the doctor bears some responsibility, while the nurse, who was merely following orders, is exempt from liability.

Question:  What if the nurse had enough medical knowledge to know that the doctor's advice was bad, but went ahead with it anyway? Would that make a difference in regards to the halacha?

Answer: Yes. Rav Goldberg compares this to a Gemara that says that if a beis din accidentally loses count of how many lashes a person received and hits him additional times, the agent of beis din who is actually doing the hitting is held liable and has to go into exile if the person dies. The reason for this is because the agent was capable of counting on his own; therefore, he can be held responsible for striking the man more than was warranted. We can learn from here that if a nurse is capable of knowing on his own that the higher doctor is giving bad orders, he would be responsible for the outcome. This also would reduce the doctor's liability somewhat, as his damage can no longer be considered garmi, as garmi only applies when one's actions will certainly cause damage, but if the nurse knows better than to do the procedure it is uncertain that he will follow the doctor's orders.

Our Alumni

HTC is proud of our alumni and their many accomplishments! Take a look at this month's spotlighted alumni.

Alumnus Name: Avi Mehler

Class: FYHS Class of 2003

Where do you live: Denver, CO

Tell us about your family: I'm married with 4 kids.

What is your profession: Business Development at an Energy Company

What is your favorite memory from FYHS/HTC/Kayitz:

I loved the camaraderie with my classmates and Rebbeim. As a dormer, there was a special connection that I had with my fellow dormers around Shabbasim. Lots of informal learning that's shaped me. I also have a fond memory of being on the basketball team and am still in touch with Sid Singer. I'm also still in contact with a number of Rebbeim and cherish those relationships.

A lesson/takeaway from your time at FYHS/HTC/Kayitz:

The Yeshiva helped me lay a foundation for the way I lead my life and raise my family. There was a big stress on Torah learning and how to treat people. They inculcated that into our education.

What advice do you have for current students:

Maximize your time there. Try to develop lifelong connections with your rebbeim. These are the people who are together with you as you develop and mature.

Anything else to share?

It is important for people to appreciate what the Yeshiva provided for them and express their gratitude. They tried to infuse and give over the best well-rounded education for a Yeshiva high school.

Alumnus Name: Yoni Gesserman

Class: FYHS Class of 2000

Where do you live: Brooklyn, NY

Tell us about your family: I'm married to Adina with 5 kids.

What is your profession: I'm an Accountant working in tax and before that, had the privilege of learning in Lakewood for 8 years.

What is your favorite memory from FYHS/HTC/Kayitz:

The Yeshiva gave me a strong foundation of learning Torah, enjoying it, and making time for it. I also made strong connections with Rebbeim. It allowed me to remain connected to a strong learning environment, even when I left the walls of the beis midrash. I'm still in touch with a number of the rebbeim such as Rabbi Kaminetzky. Rabbi Weiss is in the same retirement community as my parents in Lakewood. I still speak to Rabbi Schuman. I actually just showed my kids the Purim shpiel from my senior year. I still sing with my kids Mashiv Haruach U'Morid HaGeshem 100 times on Shmini Atzeres just like we did in the Yeshiva!

A lesson/takeaway from your time at FYHS/HTC/Kayitz:

The Yeshiva plays a unique role in taking talmidim from many backgrounds and giving them a strong learning foundation. It doesn't matter where a person is coming from as long as they are all going to the same place. Setting the students up for a future life as Ben Torah.

What advice do you have for current students:

My advice would be to develop meaningful relationships with Rebbeim. They help you stay true to your ideals when you leave the beis midrash to stay committed and connected.

Anything else to share?

I see the value in staying connected to the Yeshiva so the Rebbeim can see their investments into us have paid off all these years later.
