Introduction

Choosing the Bais Din that will hear a case can be the most difficult part of a Din Torah. It is very common for litigants to disagree on whom to appear before. The general rule is that the defendant will have the upper hand in choosing the venue, but if the plaintiff is not amenable to his choice, a "Zabla" may be the only option.

Points to Ponder

• Are there situations wherein a defendant can be forced to appear before a specific Bais Din? • What is a "Zabla" intended to be, and how is it commonly arranged? • If a party chooses a Bais Din or Dayan that is unscrupulous, is there any recourse? • Would a Bais Din issue a temporary injunction against the property of the defendant? What if this may cause him a loss?
