Introduction

In the eyes of the Torah, an intrinsic characteristic of ownership is the owner’s mental connection to their possession. When an item has been lost and the owner has given up on retrieving it (yeiush), the Torah no longer requires the finder to return it to them.

Points to Ponder

• What is the source of the concept of yeiush?

• If the owner does not yet know that he has lost his item, but he will undoubtedly give up on retrieving it as soon as he becomes aware, must the finder return the item?

• Is there any obligation to return an item that the owner has given up on retrieving? Does it matter if the person is poor and really needs the item?

• If one comes across an unmarked item that will certainly never be returned because it cannot be identified, must he pick it up or can he ignore it?
