Wednesday February 29, 2012 9:28 AM It is about nine months since Yaakov Yosef Grunwald’s appeal rejection, which set in motion transfer proceedings to Israel, and now, Matzav.com has learned, his release from Japanese prison could be imminent. A letter issued by the Japanese Justice Ministry yesterday indicated that it has taken the next step in extraditing Yaakov Yosef to Israel, where he would serve the duration of his six-year prison term. The Israeli yeshivah bochur, who was arrested in 2008 when drugs were found in a false bottom of his suitcase, is still in his Japanese detention cell, although all immigration procedures needed for the transfer have been completed for months now. The final release and deportation orders were signed months ago, and his belongings are packed and all ready to go. Askanim were pleasantly surprised back in early September when all the required documents, normally the biggest headache in a bureaucracy, were already signed and returned. The Israeli Ministry of Justice replied fairly quickly to a Japanese questionnaire asking where Yaakov Yosef would potentially serve the remainder of his sentence, in what conditions and when will he be eligible for early release under Israeli law. In a nutshell, what has held up Japan’s release of Yaakov Yosef is their reaction to what they deem to have been Israeli leniency in commuting the sentences of the previous two boys. The Japanese thus wish to have Yaakov Yosef serve at least two-thirds of sentence in Japan before releasing him. That will be in early April, at which time the Japanese are expected to permit Yaakov Yosef to be taken to Israel. Initially, there was hope that Yaakov Yosef would be transferred at least two weeks before Rosh Hashanah. The appeal of Yaakov Yosef, who had received a six-year sentence, benefited his friend Yoel Zev Goldstein, who received a rare acquittal in August and has already returned to Israel. Yossi, the first of the bochurim to stand trial, was sentenced to five to eight years in prison. Close to a year after his May 2009 verdict he was transferred to Israel. According to Japanese law, a prisoner is eligible for parole after serving a third of his sentence, while Israeli law requires serving two-thirds (although in Japan n one receives parole before serving 75% of a sentence). Yossi, who was now governed by Israeli law, still had quite some time to serve before completing the two-thirds to enable him to appear before a parole board. Therefore he requested that his sentence be commuted, which would mean he would be released on parole sooner. In January 2011, the Israeli Gov commuted his sentence to the more lenient interpretation of five years, of which he had already served nearly half. Yossi’s sentence was eventually commuted, which enabled him to appear before the parole board, and he was released on parole and is now bound to the strict parole conditions. The Japanese Ministry of Justice, upon hearing of the release last February and receiving information of various media reports that Yossi was “pardoned” triggered the Ministry of Justice in Japan to open an inquiry as to what had really happened to Yossi and under what circumstances was he released, and requested for a full account in order to verify whether Yossi was pardoned or merely released on parole. The Ministry of Justice in Israel had replied and had given a full report on the events that led to the release of Yossi that clearly stressed that he was released on parole rather than a pardon, but somewhere in the Hebrew to English translation it appeared to the Japanese that he had perhaps received a ”partial pardon” rather than the agreed parole. The red flags were then raised for the second time. The Japanese then asked for a full brief on Israeli pardon law and whether Yaakov Yosef could conceivably be pardoned prior to serving out his term. They also demanded further proof that Yossi was not pardoned, partially or fully. Nearly six weeks (November 1) after the Israelis had translated their pardon laws and sent it to Japan, there was notification of a correspondence from the Ministry of Justice in Japan and everyone was excited, because all that was needed was the final reply from the Japanese and Yakov Yosef was literally waiting by the door to be collected, but when the letter was opened, the excitement was over in seconds. The new letter from the Ministry of Justice in Japan was just raising further inquiries relating to those laws. Meanwhile, Yaakov Yosef is still waiting for the day he can see and hug his parents, and meet his sister’s husband, whom he has never met, and the child they had, as well as his new sibling who was born while he was in prison. Yaakov Yosef was the strong one among the three bochurim. The tantalizing taste of freedom which appears so near but keeps getting bogged down in a sea of bureaucracy weighs on him and his parents. The posek hador’s fever began climbing and doctors fear that he may have pneumonia. He remains in a cardiac intensive care unit on the 10th floor in Jerusalem’s Shaare Zedek Medical Center. After weeks of cautious optimism, and a series of encouraging news from the tenth floor at Shaarei Tzedek Medical Center – the condition of Maran Hagon Rav Elyashiv Shlita has taken a turn for the worse. R’ Shlomo Kook, the official spokesperson for the home of Rav Elyashiv, tells YWN that the Posek HaDor was running a fever – and doctors are concerned. After 25 days of hospitalization, and the partial removal of the respirator, it has once again been turned on, to assist Rav Elyashiv with his breathing. In this week's Parsha the Torah tells how Hashem commanded Moshe Rabbeinu to instruct the Jewish People concerning bringing donations for the construction of the Mishkan. Although today we no longer have a Mishkan, nor a Bais Hamikdah, the concept of serving Hashem with one's money is very much prevalent, primarily with regard to Tzedakah, the Mitzvah of giving charity. The Torah, when commanding to donate for the Mishkan, states "From every man whose heart motivates him you shall take his donation." The Targum Yonoson Ben Uziel explains this to mean that the Torah specified not to force people to give donations, unlike some other mitzvos which the Beis Din is enjoined to ensure are carried out by all Nonetheless, the mitzvah of giving tzedaka is indeed enforced by Beis Din in some situations and for certain causes. Nowadays, Beis Din does not have the authority to actually force anyone to do anything, but there are instances in which Beis Din can apply social pressure to ensure compliance of the mitzvah of giving charity. Please be Mispallel for the Vizhnitzer Rebbe Shlita of Bnei Brak, who is being treated for difficulty breathing and an infection. A massive crowd gathered in the main Vizhnitzer Bais Medrash in Bnei Brak, Sunday afternoon, following a request for Tehillim from the Rebbes Gabbai. Doctors are deciding if they should continue treating the Rebbe at his home, or they should have him moved to a hospital. The Rebbes children were at the home today, which include his sons Rav Yisroel, Rav Mendel, and daughters who are married to Rav Menachem Ernster (Rosh Yeshiva of the Vizhnitzer Yeshiva in Bnei Brak), the Satmar Rebbe from Kiryas Yoel, and the Belzer Rebbe. His other daughter who is the Rebbitzen of the Skver Rebbe (New Square) has departed New York for Bnei Brak on Sunday. Rav Yisroel Hager has been leading the Bnei Brak Chassidus since the Rebbe became unwell in recent years, while his son Rav Mendel Hager was appointed at the Av Beis Din of the Chassidus. YWN[chicago-aneinu] Rav Elyashiv: “A Medical Miracle

According to doctors at Shaare Zedek Medical Center, the situation surrounding the condition of Maran Posek HaDor HaGaon HaRav Yosef Sholom Elyashiv Shlita is nothing short of a “medical miracle”. They are now talking about a timetable surrounding the rav’s possible return home. Yehuda Schlesinger of Yisrael HaYom reports the rav has returned to speaking with those around him and all assisted breathing adjuncts have been removed. One must remember that the posek hador, who is almost 102, davened korbanos on erev Shabbos by heart, not to himself but audible, for others to hear, to the astonishment of all those around him. He is very weak, but speaking with those around him and the rav is questioning what is planned for a Purim seuda. The doctors report “no one expected the rav to return home but now, this appears to be a realistic possibility”. The rav was in cardiac arrest, revived, and has undergone a number of life-saving procedures. Doctors are simply astounded, including the frum members of the medical team who understand the power of tefilla and the unique stature of the patient as a gadol b’torah.

As reported here on Matzav.com, yesterday, a name, Chaim, was added to the rosh yeshiva’s name. His name for Tehillim is Rav Chaim Yisroel ben Chana Tzirel. Yeshiva World Baruch Dayan Emmes: HaMekubal Rav Nissim Peretz ZT”L (Tuesday, February 21st, 2012) Mekubal HaRav HaTzaddik Nissim Peretz ZT”L was niftar early Tuesday morning, 28 Shevat 5772 after battling a difficult illness during recent months. The rav was diagnosed with the difficult illness a number of years ago and after treatments, appeared to have been in recession. However, signs of the illness returned a number of months ago. The rav returned his neshama at 5:00am this morning at the age of 65 in Sheba Medical Center at Tel Hashomer. The levaya began at noon from Beit Knesset Beit El at 22 Menachem Street in Bnei Brak. The rav is survived by 13 children, one unmarried, as well as many grandchildren and talmidim. --

Yeshiva World Update on Maran Rav Elyashiv (Monday, February 20th, 2012) The following update was received from Rabbi Shlomo Kook on Sunday, 27 Shevat 5772 regarding the condition of Maran Posek HaDor HaGaon HaRav Yosef Sholom Elyashiv Shlita. The update comes from Rav Kook, the official spokesman for the home of the posek hador amid much disinformation being reported in the media, including the chareidi media. Rav Kook explains that on Sunday, there was a “substantial improvement relatively speaking, with an emphasis on the word relative” and the rav is responding to external stimulus now that he has been brought out of the medically induced coma. Rabbi Kook adds the tzibur is urged to continue being mispallel for the rav, Yosef Sholom ben Chaya Musha b’soch kol cholei am yisrael. In this week's parsha the Torah instructs us concerning the mitzvos of mishpat - monetary laws. It is noteworthy that this immediately follows the giving of the Torah on Mt. Sinai. Rashi explains that this is because the Torah wishes to emphasize that these mitzvos were also given on Mt. Sinai just as the Ten Commandments were. The Terumas Hadeshen adds a further elucidation. He writes that every society must have a system of justice in place, without which anarchy reigns. The Torah's laws of civil justice are essentially logical and understandable, and as such, one might have thought that Moshe legislated them himself, Heaven forbid. Therefore, the Torah emphasizes that these laws were divinely ordained and were instructed to Moshe on Mt. Sinai by G-d Himself. Rashi continues to explain that the first passuk of the parsha serves as a prohibition for Jews to adjudicate financial issues in a secular court. Rashi adds that in addition to this prohibition, there is a severe Chillul Hashem involved in doing so. This is because by turning to a secular court system one is equating its laws to those of the Torah, or worse still, preferring them over the Torah. We shall do and we shall listen (Shmot 24:7). The nations of the world have difficulty understanding how it's possible to "do", in other words, to implement a commandment, before they "listen" to the logic and the underlying rationale of the commandment. In such a frame of mind, they refuse to observe anything that goes against their thinking. In stark contrast, "We shall do and we shall listen" is the foundation of Judaism. Many people harbor the mistaken notion that one must be daft to "blindly observe" Hashem's commandments. But, for a faithful Jew, observance is never blind. A Jew with even a minimal measure of cognizance knows that The Almighty created the world; therefore, He alone knows what's best for the world in general and for each of His creations in particular. Shlomo Hamelech (King Solomon), the wisest of all men, said (Mishlei 16:32), "Self control is greater than capturing a city." Self control means winning the battle with one's own evil inclination, or Yetzer Hara. The Torah offers us the only proven strategy to win the battle against the evil inclination, the most difficult battle of all. First, we must do what the Torah tells us to, and only afterwards, ask questions.

Translated and abridged by Rabbi Chanan Morrison Parshat Mishpatim Amongst the various laws in Mishpatim — nearly all of societal or interpersonal nature — the Torah outlines the laws of compensation for physical damages. When one person injures another, he must compensate the damage with a financial payment covering five components. He must pay for permanent loss of income due to the injury, embarrassment and pain incurred, loss of work while the victim was healing, and medical expenses. This last component, that he 'provide for his complete healing' (Ex. 21:19), is of particular interest. The root-word 'to heal' appears 67 times in the Torah, almost exclusively referring to God as the Healer. Only here, as an aside to the topic of damages, is it made clear that we are expected to take active measures to heal ourselves, and not just leave the healing process to nature. This detail did not escape the keen eyes of the Sages. "From here we see that the Torah gave permission to the doctor to heal" (Berachot 60). Yet we need to understand: why must the Torah explicitly give such permission to doctors? If anything, we should expect all medical activity to be highly commended, for easing pain and saving lives.

After we learn that Chanun, son of the King of Ammon, took over the kingdom upon his father's death, the verse relates what King David was thinking, “I shall do an act of kindness for Chanun, son of Nachash, just as his father acted with kindness towards me. So David sent [a message] to him by the hand of his servants to console him over his father...” According to the Rashi, King David is referring to the fact that Nachash, Chanun's father, protected King David's brother after the King of Moav murdered the rest of his family. As a gesture of gratitude, King David wanted to comfort the mourning Chanun. The Medresh Rabbah (Bamidbar 21,5 “Tzaror”) tells us that Hashem was upset with King David for comforting Chanun. “You went against My words. I wrote 'Do not seek out their welfare or good for all days' and you do an act of kindness towards them? The verse in Koheles says, 'Do not be too righteous.'” This medresh seems perplexing. The Kesef Mishnah (Laws of Kings 6,6) brings the words of the Yerai'im who says that it is permitted for a Jew to do an act of kindness to a person from Ammon and Moav if this is done to show gratitude for a good deed that that person did for him. If so, then how then do we understand, the Kesef Mishnah asks, the Medresh Rabbah which reveals to us that Hashem was critical of King David's behavior towards Chanan?

YWN Update on Maran Elyashiv Shlita (22:15 IL)

Maran Posek HaDor HaGaon HaRav Yosef Sholom Elyashiv Shlita remains in serious condition in a cardiac intensive care unit in Jerusalem’s Shaare Zedek Medical Center. The rav has been taken out of the medically induced coma and is responding to external stimulus. The coming days doctors explain are extremely significant towards evaluating the rav’s condition and his ability to return to his state prior to the admission to the hospital some two weeks ago. Two weeks after being admitted to a Shaare Zedek Medical Center cardiac intensive care unit, Maran Posek HaDor HaGaon HaRav Yosef Sholom Elyashiv Shlita remains in critical/stable condition. “An improvement” has been reported in the rav’s condition, but there are no details explaining just what the improvement is and to what extent the rav’s condition has improved. There are unconfirmed reports that in light of last’s week success in extubating the rav and performing a tracheotomy, doctors this will attempt to bring him out of the medically induced coma. Officials in Shaare Zedek Medical Center report that Maran Posek HaDor HaGaon HaRav Yosef Sholom Elyashiv Shlita remains in critical/stable condition at this hour, his 10th day in a cardiac intensive care unit. The rav this morning, Wednesday, 22 Shevat 5772 successfully underwent a procedure to secure a long-term airway, an alternative to the intubation that has provided a patent airway for the gadol hador during past days. The tracheotomy was performed successfully and the rav is recovering. The rav’s medical team is now deciding if they should bring the gadol hador out of the medically induced coma, a decision that is expected sometime on erev Shabbos. In verse nine of our chapter, G-d bestows a magnificent blessing on King David. The verse reads, “I was with you wherever you went – I cut down all your enemies before you and I gave you great renown, renown like the great men of the world.” The gemora in Pesachim (117b) says, “And I gave you great renown, renown like the great men.” Rav Yosef taught a braisa which reads, “That is what we say 'magein David' (one of the blessings of every haftorah) The Rashbam explains that Nasan the Prophet was quoting this as a message from Hashem. Just like we conclude a bracha “the shield of Avraham” so too we conclude a brocha “shield of David.” The Sfas Emes (Breishis Lech Lecha 5635) explains that when we say that Hashem is “magein Avraham” this means that Hashem assured Avraham that there will be a “bit” of Avraham in every Jew. This “bit” will be protected by Hashem. No one can eradicate it. We presume that this “bit” of Avraham is the root of faith in Hashem which Avraham developed and passed on to every generation and every individual Jew.

HaGaon HaRav Chaim Kanievsky Shlita, a son-in-law of Maran Posek HaDor HaGaon HaRav Yosef Sholom Elyashiv Shlita, has called on the tzibur to accept a taanis on Thursday, 23 Shevat 5772 on behalf of the posek hador. Rav Kanievsky has stipulated however that this is only for those capable of doing so without negatively impacting one’s learning, for fasting at the expense of compromised Torah study will not have accomplished its goal. Doctors at Shaare Zedek Medical Center today, 22 Shevat, will attempt to extubate the gadol hador and replace the endotracheal tube providing his airway with a tracheotomy, a relatively minor surgical procedure by which an incision is made in one’s throat, entering one’s trachea and bypassing one’s mouth. Obviously, on a 101-year-old patient, no procedure is minor. While this was attempted earlier in the week, albeit without success, reports from the hospital signal today the physicians feel the move is critical for the rav’s continued treatment. The following update on HaRosh Yeshiva HaGaon HaRav Aaron Yehuda Leib Shteinman Shlita was provided by Rav Kobi Rosenstein. The rav’s condition has significantly improved today (21 Shevat 5772) Baruch Hashem. His pneumonia appears to be responding to the medication. Doctors remain hopeful that he will be discharged tomorrow. He was not discharged today due to concerns, for doctors explain the rav’s advanced age demand extra care and observation for an additional day. The treatment for the rav is outstanding, not just medical, but the respect and privacy given to the prominent rav by Mayanei HaYeshua Hospital – so much so that I must thank the hospital publically. Maran Posek HaDor HaGaon HaRav Yosef Sholom Elyashiv Shlita remains in critical /stable condition in a cardiac intensive care unit in Jerusalem’s Shaare Zedek Medical Center. He is unconscious and remains connected to a respirator and other life support apparatus. Today is the eight day since the posek hador was admitted to the unit. HaRosh Yeshiva HaGaon HaRav Aaron Yehuda Leib Shteinman Shlita remains in Bnei Brak’s Mayanei HaYeshua Hospital and his condition has improved. The rav was admitted on Monday, 20 Shevat 5772 with a high fever. Doctors began intravenous antibiotic therapy to treat pneumonia. The rav’s condition is improving Baruch Hashem, and he davened shachris with a minyan in his room. He is expected to be released soon. HaGaon HaRav Yitzchak Tuvia Weiss Shlita, Gavaad of the Eida Chareidis remains in Shaare Zedek Medical Center where he too is receiving intravenous antibiotic therapy for pneumonia. His condition is reportedly improving and the rav, who is admitted to the sixth floor, visited the room of Rav Elyashiv on the tenth floor. HaGaon HaRav Yaakov Yosef is continuing outpatient treatment for his pancreatic cancer and is doing his utmost to continue with his rigorous schedule if shiurim and spreading Torah.
