Even before the Torah was given to Klal Yisroel at Har Sinai, a system of courts and civil justice was set up by Moshe Rabbenu to administer the legal process of arbitrating financial disputes according to the Halachah. A system of Battei Din was established, and the basic principles of procedure were put into place, and remain unchanged until today. Thus if someone has a financial claim against another, which this other person either denies or ignores, in the first instance one requests of Beis Din for them to issue a summons to the defendant to have the claim or dispute arbitrated by the Beis Din.
