THE BAIS HAVAAD HALACHA JOURNAL: Volume 5776 Issue VIX Parshas Vayeishev SELF INCRIMINATION PART II Punishments for a false witness
nderstanding Dina D'garmi There is a famous discussion in Tshuvas haRambam L'chachmei Lunel. This was written by the great Rishonim who lived in Lunel, in Southern France, including the Baal Amor, the Raavad and other Rishonim. After they received the Rambam’s Mishna Torah, the Rishonim wrote a series of penetrating questions which the Rambam answered. The Rambam writes his opinion, that there is no difference between what the Gemara calls garmi and gorem. A gorem hefsid b'chaveiro is putar b'dinei odom, and chayiv b'dinei shamayim. The previous din of don dina d'garmi is where the Beis Din is motzi is only by garmi, not by gorem. What's the difference between a gorem and a garmi?
