THE BAIS HAVAAD HALACHA JOURNAL: Volume 5776 Issue VIII Parshas Vayishlach SELF INCRIMINATION PART I Can a false witness implicate himself as guilty?
The Gemara in Makkos, Daf 3A, says Eid zomem meshalem lifi chelko – the eid zomem pays according to his share. Rava’s explanation of this cryptic statement is, B'omer eidus sheker heiaditi. One of the witnesses admits that he testified falsely. If Reuven and Shimon testified that Ploni owes Almoni one hundred dollars, and then Reuven admits that he said an edius sheker – a false testimony, the halacha is that he has to pay half of that which he caused the Bais Din to extract from Ploni to pay Almoni. If, due to Reuven’s false testimony, Ploni paid Almoni one hundred dollars, then Reuven must pay fifty dollars of that payment.
