Do You Have to Pay the Rov for Selling Your Chometz?


Question: I noticed that during mechiras chometz, everyone gives the Rav a check. Does one have to pay the Rav to sell the chometz?

Answer: The minhag Yisroel is to pay the Rav for selling the chometz on your behalf and there is a benefit to doing so. 


The Rav doesn't buy your chometz from you. He's just a shliach, an agent, to sell it for you. If you pay him, you change him from the status of a standard shliach to the status of a po'el (a hired worker). One benefit of that is if you buy chometz after the shtar is signed. At the time of the writing of the shtar, that chometz was as yet a davar shelo ba'ah l'olam and one cannot make a shliach on something that doesn't yet exist in their possession. But when you make the Rav into a po'el, he is like your worker and can continuously deal with your chometz.

 

Another benefit is that normally, the rule is that for a d'ohraysa one cannot rely on a shliach and just assume that he carried out his job. But if he's your worker, you can rely on him that he did his job and sold the chometz for you.
