THE OU'S Taryag: The 613 Mitzvos mitzva 34. You Slay Me: The prohibition against murder

34. You Slay Me: The prohibition against murder

You shall not murder (Exodus 20:13)
Let’s get one thing straight: it’s not “Thou shalt not kill” (which would be “lo taharog” in Hebrew), it’s “Thou shalt not murder” (which is “lo tirtzach” in the Torah). There’s a huge difference between the two. Sometimes circumstances force us to kill, for example in self-defense, in battle, or when executing a convicted felon. But we may not murder, which is to wantonly slaughter innocents.

We were put on this world to build the world and to settle it. To multiply and fill the world is the very first commandment. To kill innocents goes completely counter to that ideal. Everyone enjoys the right to live, those certain people forfeit that right through their destructive deeds. The Sefer HaChinuch cites the Talmud in Baba Metzia 83b that executing criminals convicted of capital crimes is analogous to weeding one’s vineyard in that it actually fosters the growth of society rather than impeding it.

Human life is so precious that even closing the eyes of a dying person, hastening death by mere seconds, makes one a full-fledged murderer and liable to the same punishment as one who killed a healthy individual (Semachot 1:4).

Murder is one of the three mitzvos for which one must be prepared to give up his own life rather than violate it. (The others are idolatry and certain forbidden sexual relations.) These mitzvos are called “yehareg v’al ya’avor,” meaning “allow oneself to perish rather than violate.” The rationale in the case of murder is that we have no way of determining whose life is more important. Therefore, one may not sacrifice another to save himself (see Talmud Sanhedrin 74a).

The prohibition against murder applies to both men and women in all times and places. This is #289 of the 365 negative mitzvos in the Rambam’s Sefer HaMitzvos and #32 of the 194 negative mitzvos that can be fulfilled today in the Chofetz Chaim’s Sefer HaMitzvos HaKatzar. In the Talmud it is discussed in the ninth chapter of Sanhedrin and in the second chapter of Makkos; in Shulchan Aruch, it is found in Choshen Mishpat 425.

The Daf Yomi - In-depth practical case-study analyses derived directly from each day’s Daf. SHEVOUS DAF 20 WHEN IS THE YAHRTZEIT

Q:When is the yahrtzeit for a person the death or burial and what do you do on that day

A:The S"A says no meat or wine and you should fast on the yahrtzeit Rav Shternbauch the Chazonish and the Steipler say that if by fasting on the yahrtzeit you will not be able to learn do not fast. The Trumas Hadeshen brings a proof from our gemara which says someone made a neder day father died and see churban Yerushaliem who can eat(9 days connection) so to day of death who can eat so the yahrtzeit on day of death. The Shach says for the aval and family the yohrtzeit and year are bad mazal they need teshuvah the Mahram Mitz says it is a caparah for the father who died on this day the Arizal and KS"A say the zcus of children doing mitzvos torah and masim tovim the father goes higher the Rema says yahrtzeit is not by death but by burial we do not follow this. When the person dies on Thursday but is not buried till Monday big shilah when the yahrtzeit of the 1st year Shach and Masas Binyamin minhag olam is yohrtzeit 1st year is day of burial but if death is Thursday and burial is Friday the yahrtzeit on day of death.Rav Moshe says 1st year yahrtzeit on day of burial but after that yohrtzeit on day of death but the Taz argues and says every year yahrtzeit on day of death.
I heard Rav Wosner and Rabbi Zev Cohen say in this case 1st year yahrtzeit on day of burial after that the yahrtzeit on day of death

Young mother delivered twins last night then kept having seizures that
could not
be controlled (secondary to preeclampsia). She is currently in a medically
induced Coma and on a
respirator (intubated). R' Chaim Kanievsky suggested adding the name
Ruchama to her name, which

I want to thank everyone for your thoughts and tefillos on behalf of our little tzaddikel..

(For those of you who haven't yet heard, I had a c-section 4 weeks ago.  My baby was born 6 weeks early, and underwent emergency open heart surgery when he was 1 day old.  He is now hospitalized in Hadassah Ein Kerem's PICU).

B"H the heart surgery was successful and his heart is healing well, but we have now encountered other problems.  He has lots of fluid building up in his chest cavity, and so far he has been unresponsive to treatment.  The doctors are now deciding what step to take next.

Please daven that we should be zoche to find the right refuah for Tinok ben Yael, without him having to endure any more unnecessary pain.

Also, as a zechus for his refuah, I am encouraging women to try to bentch licht 10 minutes early this week, and to daven for him by Hadlakas Neiros.  (please note that if you make early Shabbos, you cannot light earlier than Plag).  The power of Kavod Shabbos is very strong, and I hope that this zechus will help bring about his refuah, bekarov!

Wishing you a good Shabbos,
Yael

Fw: [chicago-aneinu] Pleaase Daven

Please continue to daven for rachamim for Yechezkel Chiya ben Alta Nechama.
