THIS MONTH'S YORUCHA TOPIC:

MECHIRAS CHAMETZ

הלכות מכירת חמץ

Week 2 Focus:

הקנינים במכירת החמץ

  • KINYAN FOR NON-JEWS: MESHICHAH OR KESEF?
  • KINYAN SUDAR
  • KINYAN CHATZER
  • KINYAN AGAV
  • KINYAN SITUMTA
  • KINYAN ODISA
  • CONCLUSION

Introduction

Several complications arise when selling Chametz to a non-Jew. For one, sales between Jews and

non-Jews have different halachos than those between Jews only, and many of the halachos are

subject to intense debate. In addition, some forms of acquisition, such as taking possession of

the goods, are impractical for large-scale Chametz sales. Practically, a whole host of kinyanim are

performed each time.

Points to Ponder

• What are the standard kinyanim, forms of acquisition, that are recognized by halacha for

transactions involving non-Jews?

• Must the kinyan used to sell Chametz be recognized by secular law as well?

• Can the admission of non-Jewish ownership be considered a kinyan of its own?

• If some of the kinyanim were not performed or were done improperly, is the Chametz permitted

for use after Pesach?
