PUTING THE SPOTLIGHT ON IMPORTANT JEWISH INFORMATION
Week 2 Focus:
נהנה מנכסי חבירו
LECHATCHILA?
Introduction
Zeh Nehene V’zeh Lo Chaser refers to cases where one benefits while the owner incurs no loss, and
thus the beneficiary is exempt from paying for the benefit. The Rishonim discuss several possible
variations, such as when there is a very small loss or when there is a loss but the person received no
benefit.
Points to Ponder
• If an owner is chaser a tiny amount, can he now charge the beneficiary the full amount?
• Someone booked a place to stay and mistakenly stayed somewhere else that was vacant. Does he have
to pay for either one?
• My friend is away for a few weeks and has a paid parking spot in the city. Am I allowed to park there?
• If I used the soundtrack of a popular song for my production, do I have to pay the artist?
