Introduction

The Torah obligates a person to be aware of all their actions and the ways in which these actions can impact others. Thus, the cardinal rule of adam hamazik, a person who does damage, is that adam muad l’olam, he is fully liable even if he had no intention to cause the damage. 

Points to Ponder

• If a person caused damage through an unavoidable circumstance, is he liable under the principle of adam muad l’olam?

• Does a trespasser have rights? If the homeowner injures him, directly or indirectly, is he liable?

• If two cars collide while squeezing through a narrow road, how is responsibility determined in halacha?

• Is releasing a damaging force the same as doing direct damage? If one opens floodwaters that flood a neighbor’s property, is that adam hamazik?
