Week 2 Focus:

תנאי אבידה

  • THE EIGHT CONDITIONS FOR HASHAVAS AVEIDAH
  • AVEIDAS AKUM: A LOST ITEM BELONGING TO AN AKUM
  • LOCATIONS WHERE MOST PEOPLE ARE NOT JEWISH
  • THE DEFINITION OF SHAVEH PERUAH FOR HASHAVAS AVEIDAH
  • FINDING A MUKTZEH ITEM ON SHABBOS

Introduction

The Torah gives several prerequisites that limit a finder’s obligation to return lost items. For example, the item must belong to a Jew, he must not have given up on retrieving it, and it must be worth at least a perutah.

Points to Ponder

• How should a finder go about establishing whether or not the lost item belongs to a Jew?

• If one finds an object that definitely belonged to an Akum, is it the right thing to return it?

• Must one return an item that has no value at all to anyone except the owner, e.g., a single shoe or a pair of glasses?

• What should a person do if he comes across a lost muktzah item on Shabbos? Does the mitzvah d’oraysa of hashavas aveidah override the Rabbinic prohibition of handling muktzah?
