Introduction

For some people, a "heter iska" is a mystical formality that somehow permits lending with interest. Not only is this not true, but the earlier poskim warned against using a heter iska unless the parties are aware of how it works. The basic idea of a heter iska is to convert a loan into an investment, exposing the investor to enough risk to justify accepting returns on his investment.

Points to Ponder

• Why can't every loan simply be called an investment in order to make it "kosher"?

• What is the basis of the famous "dollar" that accompanies many iska agreements?

• How much risk must an investor assume to justify his returns? Can an investor protect his investment as a preferred equity?

• What are the different types of heter iska in use today and how should one decide which one to use?
