Introduction

The idea of shlichus is that the agent can act as if he were the principal who authorized him. In cases where the principal himself cannot fulfill the agency, such as when the principal has become incapacitated, the entire premise of the agent's authority is called into question.

Points to Ponder

• If a man appoints an agent to deliver a get to his wife, and the husband dies prior to the delivery, can the agent deliver it to her anyway?

• Can an agent appointed to facilitate a monetary transaction, such as buying or selling, fulfill his agency if the principal becomes mentally incapable?

• To what extent is an agent considered the principal – can he wear tefillin or eat matzah on his behalf?

• Is a legal power of attorney sufficient to empower an agent to continue after the death of the principal?
