Week 4 Focus:

חרש ושוטה, ומינוי אפוטרופוס

  • THE STATUS OF A DRUNKARD
  • THE DEFINITION OF A CHEIREISH
  • IDENTIFYING A SHOTEH
  • EXECUTORS

Introduction

Unfortunately, children are not the only ones that lack the necessary daas to be involved in

commerce. Adults who fit into the categories of chereish or shotah are also limited in their

ability to engage in commercial transactions. In those cases, a halachic executor (apotropus)

should be appointed to manage their affairs.

Points to Ponder

• Can a person with hearing aids or cochlear implants buy or sell real estate?

• If someone engaged in a bad deal because he was intoxicated at the time, can he undo the transaction when he becomes sober?

• What is the halachic definition of a shoteh in regard to commercial transactions?

• Does halacha recognize the authority of a court-appointed executor?
