Update on Reuven 06/29/10

Hi Everyone. As many of you know, Reuven, together with his family, recently moved back to their hometown here in Chicago. Like other kids his age, Reuven was signed up for camp here at the local JCC. He started on Monday...a regular normal day of camp with swimming, sports and freeze pops. Yesterday, however, Reuven was admitted to Children's Memorial for complaints about a pain he was having on his forehead. an MRI determined that there is a tumor on his skull (not his brain, B"H) which will require treatment of some sort. It is unsure whether they will do surgery or some other kind of treatment. Further tests will be done tomorrow IY"H to determine the plan.

During these days of the 3 weeks, please continue to have Reuven ben Tova Chaya in your tefillos for a full refuah shleima bemheira.

20. A Blindfold, Maybe?: The prohibition against seeing chometz in one’s domain on Passover

21. My Four Sons: The obligation to relate the Exodus from Egypt on Passover night

And you shall tell your son on that day, “It is because of this that God acted for me when I left Egypt” (Exodus 13:8)
Many of the mitzvos in parshas Bo relate to Pesach, remembering the Exodus and reenacting it in a fashion. Here, we are specifically instructed to tell the story of the Exodus, especially (but not exclusively) to our children. In fact, it is still a mitzvah to tell over the story of the Exodus even if one is all alone on Seder night. (In verse 3, Moshe tells the people to remember the day they left Egypt – even in the absence of others to whom to relate it.) The reason we do so much to commemorate and recall the Exodus is that it was the seminal event in the formation of the Jewish people; on that day, God took us out of Egypt to serve only Him.

This mitzvah is fulfilled at the Seder, specifically in the portion called Maggid. (The words Maggid and Haggadah come from the Hebrew word meaning to relate or to tell.) At the Seder, we drink four cups of wine, corresponding to the four terms used in the Torah to refer to our redemption, and we are obligated to explain the significance of the korban Pesach, matzah and maror (Passover offering, unleavened bread and bitter herbs). The section of the “Four Sons” uses our verse here and others to describe the ways in which different personality types might pose their questions and the proper way for us to respond to each.

The “this” in our verse refers to the matzah, maror and, in the time of the Temple, the korban Pesach. As the Haggadah discusses, this is how we know that the obligation to relate the Exodus is on the Seder night. As Rashi explains it, “Because of this – i.e., because I fulfill His mitzvos, such as this (korban) Pesach, matzah and maror.”

This mitzvah applies to both men and women in all times and places. It is discussed in Talmud Pesachim on pages 116a-b. The halachos of the Seder can be found in the Shulchan Aruch in Orach Chaim 472. This mitzvah is #157 of the 248 positive mitzvos in the Rambam’s Sefer HaMitzvos and #24 of the 77 positive mitzvos that can be fulfilled today as listed in the Chofetz Chaim’s Sefer HaMitzvos HaKatzar.

Moshe's son, Dovid Yosef ben Faiga Perel, has been moved to the intensive care unit at Shneider's Hospital in Petach Tikvah. He will be watched very closely for the next 24 hours to see the reaction he has to the procedure performed a few hours ago. He has a serious head injury but the exact damages are not yet known at this time.

When he entered the hospital he was responding to the doctors. That is a positive sign, although I do not know if he was talking.

Dovid, 16 years old, is a volunteer fireman and had just finished a shift in Alfei Menashe. That town is about 15 minutes from where he lives and he – and the other young volunteers – was being driven home by one of the adult firefighters. I do not have a full report of the accident but it seems that the car he was a passenger in swerved out of control, hit the side rail and was then smashed by the car behind. Every one on the car was injured, although Dovid was the only one injured seriously. All others sustained light injuries.

Rhonda and I were at the hospital today. Since Dovid is in "intensive care" all people visiting can only sit and spend time with Moshe and Tzippy in the waiting room. Baruch Hashem, the room was full of neighbors and friends.

This was my first time – since the accident – that I spoke to Moshe. He told me that while things are still in the danger stage, there is a ray of hope. The main concern of the doctors is Dovid's brain and they are watching that closely. In addition to the brain injury, Dovid's eyes were badly damaged as well. Many bones were broken in his face below the eyes (cheekbone area) and one of his eyes is in serious danger as well. In addition, he suffered injuries to his lungs and hip. Moshe told me that Dovid is getting amazing care from the medical team and that every one is giving Dovid their top attention. Moshe even told me that in the intensive care unit there are several non-Jewish patients from Europe whose parents flew their children to Israel to Shneiders Childrens Hospital . (How ironic is that ???!!!) This hospital is known as one of the best children's hospitals in the world and Moshe and Tzippy are very confident in the ability of the doctors.

 While I was there, a new CT was taken but so far, no results were given.

 As far as the accident is concerned it seems that the car in front of Dovid did a totally random and illegal U-turn. The car that Dovid was in swerved to get out of the way and as a result hit the side rail and crashed directly into a big street light. The car behind them hit them as well. Baruch Hashem, Dovid was wearing a seat belt or things would have been much worse. I have attached pictures of the car after the accident. Dovid was sitting in the front passenger seat and sustained the direct blow from the big light poll that hit – and fell – on to the car. As you will see, the car literally wrapped around the poll.

 Two hours ago, Tefillot were said for Dovid in Meron (by the kever of Rabbi Shimon bar Yochai), Ma'arat Ha'Machpela ( Hebron ) and by the Kotel. All Tefillot are welcome anywhere in the world.

 I will be coming to NY this Friday and wanted to organize a Tehillim gathering by the Lubavitcher Rebbe's Ohel. As you know, Moshe is related to the Rebbe and comes from a long line of Chabad Chassidim. For those reading this in the NY area, please email me a time when you can meet. I would like to meet around 10 or 11AM.

A:The S"A says says someone who opens the same business who lives in the same city there is no isur of encroaching only an out of towner opening the same business is their a problem but the poskim say their are hetarim if their is a monopoly with high prices someone from out of town can open the same business to make prices go back to normal in other words it is good for the consumer but if it is not good for the consumer then even an in towner cant have a monopoly.If a business is in the district like diamonds or used cars you get more business someone else can open a used car lot or diamond store.A national business like an insurance company has no encroachment.There are a minority of poskim who say nowadays bais din has no power so bais din can not command an out of towner to not open a business so there is no encroachment laws nowadays but Rav Rappaport says this is illogical the laws of encroachment are a mtzva ban adam licavaro(between man and man) it is not nice to do this

BATTLE CREEK, Mich. - Kellogg Co. is voluntarily recalling about 28 million boxes of Apple Jacks, Corn Pops, Froot Loops and Honey Smacks cereals, saying a "waxy" smell and flavor coming from the package liners could make people sick, the company said Friday.

Kellogg spokeswoman J. Adaire Putnam said about 20 people complained about the smell, including five who reported nausea and vomiting. The company said the potential for serious health problems associated with the cereal is low.

Putnam said the lining of the cereals' boxes produced the waxy smell and flavor. Kellogg is trying to identify the substance on the liner that's causing the problem.

The products were distributed throughout the U.S. and have been on the market since late March.

Kellogg's shares were unchanged in midday trading.

Consumers concerned about the recall — or seeking a refund — can contact the Kellogg Consumer Response Center at 888-801-4163 from 8 a.m. to 8 p.m. Eastern time.

A: The Trumas Hadeshen says it depends on the shaver if it presses against the skin using the skin as a backboard like a norelco and panasonic shaver are a problem but if it protect against the blade it is like a scissor and muter. The Chacmas Adam says a razor cuts below the skin to expose skin but a scissor does not expose hair under the skin. So if your electric shaver exposes hair under the skin it is like a razor and it is asur but if your electric shaver does not expose hair under the skin then it is like a scissor and is muter.Rav Moshe would pluck a beard hair and see if the electric shaver would cut the dangling hair if it did it is very sharp and like a razor so its asur but if it did not cut the dangling hair its like a scissor so it is muter

THE OU'S Taryag: The 613 Mitzvos mitzavah 19. Back to Pesach: The prohibition against eating chometz on Passover


As with the other Passover-related mitzvos, the reason is to publicize the miracles that God wrought when He extracted the Jews from Egypt. Chometz is a leavened product of one of five grains: wheat, barley, rye oats and spelt.

The Zohar (2:182) equates eating chometz on Pesach to idolatry.

This is because God killed every firstborn of Egypt – both man and beast – during the last of the ten plagues. The Torah tells us (Numbers 8:17, et al.), that as a consequence of this, the firstborns of Israel are dedicated to God.

Mandi suffers from leukemia and we are in search of women expecting a baby
in the next 30 days of German, Russian, or Ukrainian descent (or any
combination thereof). We would ask those we can locate to sign up to a
registry indicating they are willing to be considered to donate their
umbilical cord blood (this process is free and takes place after delivery;
the umbilical cord otherwise gets thrown away). Location does not matter;
the cord blood can be transported from anywhere in the world.

We are calling on all logical resources of people who might have access to
reach such women, their OBGYN or other caregivers, or media outlets that
reach these audiences either here or abroad to help us spread the word.

The Rambam’s Fourth Principle: Commandments that refer to the mitzvos as a whole are not mitzvos


Mom and Dad are going out for the evening and they give their son instructions throughout the day. At 10:00 AM, they tell Junior, “No parties.” At noon, they say, “Don’t open the door for strangers.” At 4:00 PM, they say, “Lights out at midnight.” When they leave, they say, “Do everything we told you.” How many rules did Mom and Dad give Junior? Three: no parties, don’t open the door for strangers and lights out at midnight. “Do everything we told you” is not a separate agenda item.

A:The S"A says when a meut is common we do not say rov which applies by lettuce.The Mishkinos Yaakov and Rav Shilomo Zalman Aurbach say a 10% infestation needs to be checked Rav Elyashiv says a 20% infestation needs to be checked.The 3 step process for checking for bugs is 1. soaking in soapy water 2.rinsing in water 3. bedikah(checking for bugs).Some organizations say a frozen bug is like dirt no ciuv malkos others say bugs body chemicals are not rotted so it is a problem. Rav Shilomo Zalman Aurbach says if you put the broccoli in a blender the bug is broken into pieces and is batul so you can serve the broccoli(why is this not a case of having intent to be mivatal it b/c you tried your best to check it).

A:The poskim say a fetus that is threatening the life of the mother is not a rodaf b/c Hashem is causing it if mother life is at risk you need a Rav Movhak to tell you to kill the fetus but if you kill the baby after its head comes out it is considered murder then we let nature take its course but the mother can kill it the poskim say if someone else does it he is not ciev but the Brisker Rav says part of the matzios of threatening someone life is a basic respect a rodaf or murderer does not have life of his own he loses that zecus so he can be killed and the killer does not get the death penalty but when the baby head comes out he does not lose his zecus when he is threatening the mother if someone else kills him he would be ciev.The Chinuch says by a case of busha through onas devarim or punching you you can defend yourself and the Mordechi says if someone informing on you in a non jewish court you can go and defend yourself.

13. Wagging Their Tails Behind Them: The prohibition against feeding an apostate the korban Pesach

This is a law of the Passover offering: no apostate may eat of it (Exodus 12:43)
Let’s define some terms here. The Torah says that a “ben neichar” may not eat from the korban Pesach. But what’s a ben neichar? The word roughly translates as “alienated” or “estranged.” Rashi quotes the Mechilta that this law applies both to a non-Jew and to an apostate Jew. (A mumar – apostate – is a Jew who leaves the path of Torah to worship idols. Ravshakeh, the Assyrian officer in II Kings chapter 18, was an apostate Jew.) So, the korban Pesach was for Jews only – and not just Jews, they had to be Jews “in good standing!” (Non-observant Jews could eat of it, so long as they hadn’t turned to idolatry.)

The Talmud in Pesachim 3b relates a story in which a non-Jew bragged to Rabbi Yehudah ben Beseira, “Even though it says that no stranger may eat of the korban Pesach, every year I pass myself off as a Jew and they give it to me.” Rabbi Yehudah asked, “Do they give you the fat tail of the lamb?” The man replied that they did not. Rabbi Yehuda continued, “That’s because it’s the best part. If they don’t give it to you, they must know you’re not really Jewish.” The next Pesach, the man asked for the fat tail. However, this part of the sacrifice was offered to God, so the people in the man’s group became suspicious. They checked into his background, discovered he was not Jewish, and the jig was up.

The reason for this mitzvah is that the korban Pesach commemorates the Jews leaving Egypt to become God’s servants. It’s not appropriate – actually, it’s outright hypocritical – for a person who has turned his back on Torah to celebrate the Jewish nation’s union with God. This law applies to both men and women at the time when the Temple is standing.

The Rambam discusses this law in Hilchos Korban Pesach chapter 9. In the Talmud, it is discussed in the tractates of Pesachim (96a) and Yevamos (70b-71a). It is #128 of the 365 negative mitzvos in the Rambam’s Sefer HaMitzvos.

[chicago-aneinu] Opening Session of Trial for Third Bochur in Japan

The trial of Yoel Zev *ben* Mirel Risa Chava, the third of the three
bochurim at the center of the Japan smuggling saga, began today. Following
the final pre-trial hearing on *Erev Shabbos*, the opening session of the
trial got underway today in Japan. At the hearing, the defense and
prosecution discussed possible court dates to ensure that witnesses would be
available at those times.

The trial itself will take place during four days in July and then October.
All Japanese courthouses are closed from August 11 to August 31,
complicating matters a bit. The set dates for the trial are July 27, July
28, October 18 and October 19. October 20 has been added as an extra day in
case it is needed.

The presiding judge has stated that cancellations in his court schedule may
allow the trial dates to be moved up.

Yosef *ben* Itta Rivkah, the youngest of the three *bochurim**,* is now in
Eretz Yisroel serving the duration of his sentence in an Israeli jail.

The second of the *bochurim*, Yaakov Yosef , was sentenced to six years in
prison. It is hoped that following Yoel ’s trial, Yaakov Yosef will be
extradited and be able to serve a reduced sentence in an Israeli jail.
Counting the two years he has already spent in jail, as well as a reduction
for good behavior, Yaakov Yosef could spend anywhere from 36-48 months in
jail.

The statement of the Talmud (Makkos 23b) that God gave Moshe 613 mitzvos at Sinai expounds upon Deut. 33:4, “Moshe commanded us the Torah…” According to the Rambam, the “Torah” referred to in that verse only includes those commandments intended for posterity.

Parents should be aware and speak to their children regarding stranger danger.  Yesterday an 11-year old girl was walking her 6-year old brother, to the JCC at about 10:30 AM, when a man and a woman approached them and offered them candy.  The 11-year old immediately grabbed her brother and ran into the JCC.  The couple who approached the children were white with white-blond hair, glasses, and the male was described as chubby.  The couple appeared to be using a black sedan.

I was asked by someone close to r Brevda to send this out as soon as possible.

As you may have been aware the doctors discovered a tumor in Rav Brevda Shlita before pesach. He returned to the USA right after pesach and was operated on to remove the tumor. Nevertheless he still needs radiation/chemo treatments which he has been getting each Wednesday. The treatments are extremely painful and this is besides for the pain of the actual sickness. Yesterday he went to a new doctor who is trying to see if they can switch the treatment to something less painful.

Rav Brevda has asked that everyone daven as much as they can for him specifically now in order that he should be able to switch treatments and for a refuah shlemah

His name is Shlomo Leib ben Miriam

Agriprocessors executive Sholom Rubashkin has been acquitted of
allowing minors to work at the Postville slaughterhouse.The jury
indicated they had reached a verdict shortly before 1 p.m. Monday.

»Jurors acquitted him of all 67 counts of child labor
violations.Rubashkin is awaiting sentencing on federal bank fraud
charges in connection with loans Agriprocessors received. Federal
immigration charges stemming from the May 2008 raid at the plant were
dropped earlier.State labor officials began investigating information
that minors worked at the plant in the months before the May 2008
immigration raid.
