A:The poskim say you should avoid I promise I swear b/c it might be a shevua avoid yes yes truly you should also avoid I forbid you to touch this b/c it is a neder that needs to be matered.Children should be taught not to use these words from age 12 but if the child kavanah i9s for stealing and does not know about neders it is not a problem. You should also avoid on my life.Rav Chaim Kinevski says there is no bli neder on the Hadran by finishing a mesechta is b/c he doesnt have in mind for it to be a neder. In all cases and especially by learning 1 should always say bli neder

CHASSIDIC PEARLS BY RABBI LAZER BRODY PARSHAS EIKEV

Rashi interprets the above passage by telling us that Hashem's principal attention is focused on the Land of Israel; only afterwards, does He feed the rest of the world.

The Ramban goes a step further: He says emphatically that all the nations of the world eat by virtue of the Land of Israel, for Hashem personally seeks her only; but, when Hashem seeks her out, the other nations receive their subsistence as well.

Rebbe Nachman of Breslev explains (Likutei Moharan II:71), "There is an intellectuality of the Land of Israel and an intellectuality of the other nations. The intellectuality of the other nations feeds from the intellectuality of the Land of Israel, for the main wisdom and intellect are in the Land of Israel."

THE OU'S Taryag: The 613 Mitzvos mitzva 34. You Slay Me: The prohibition against murder

34. You Slay Me: The prohibition against murder

You shall not murder (Exodus 20:13)
Let’s get one thing straight: it’s not “Thou shalt not kill” (which would be “lo taharog” in Hebrew), it’s “Thou shalt not murder” (which is “lo tirtzach” in the Torah). There’s a huge difference between the two. Sometimes circumstances force us to kill, for example in self-defense, in battle, or when executing a convicted felon. But we may not murder, which is to wantonly slaughter innocents.

We were put on this world to build the world and to settle it. To multiply and fill the world is the very first commandment. To kill innocents goes completely counter to that ideal. Everyone enjoys the right to live, those certain people forfeit that right through their destructive deeds. The Sefer HaChinuch cites the Talmud in Baba Metzia 83b that executing criminals convicted of capital crimes is analogous to weeding one’s vineyard in that it actually fosters the growth of society rather than impeding it.

Human life is so precious that even closing the eyes of a dying person, hastening death by mere seconds, makes one a full-fledged murderer and liable to the same punishment as one who killed a healthy individual (Semachot 1:4).

Murder is one of the three mitzvos for which one must be prepared to give up his own life rather than violate it. (The others are idolatry and certain forbidden sexual relations.) These mitzvos are called “yehareg v’al ya’avor,” meaning “allow oneself to perish rather than violate.” The rationale in the case of murder is that we have no way of determining whose life is more important. Therefore, one may not sacrifice another to save himself (see Talmud Sanhedrin 74a).

The prohibition against murder applies to both men and women in all times and places. This is #289 of the 365 negative mitzvos in the Rambam’s Sefer HaMitzvos and #32 of the 194 negative mitzvos that can be fulfilled today in the Chofetz Chaim’s Sefer HaMitzvos HaKatzar. In the Talmud it is discussed in the ninth chapter of Sanhedrin and in the second chapter of Makkos; in Shulchan Aruch, it is found in Choshen Mishpat 425.

By Rabbi Jack Abramowitz

THE OU'S Taryag: The 613 Mitzvos mitzva 33. M is for the Million Things She Gave Me…: The obligation to honor one’s parents

Let’s be honest: if not for our parents, none of us would be here. Therefore, we have to respect our parents for the very fact that we exist at all. Not to do so constitutes the ultimate ingratitude. Extrapolating this one step further, neither we nor our parents (nor their parents, etc.) would be here if not for God. By honoring our parents, we are in part honoring Him.

The Rambam’s Ninth Principle: Don’t count commandments, count things to do

The Torah commands us in four different areas, the Rambam says. These are: beliefs (to accept certain things about God, not to consider heretical ideas); character traits (to love our neighbor, not to bear a grudge); speech (to bentch after eating, not to speak lashon hara); and actions (to offer sacrifices, not to bow to idols). Separate items in each of these areas are to be counted as mitzvos regardless of how many times a command may appear in the Torah.

Q:How do you give tzedaka is maser diurissa or dirabanan what are some benefits of giving tzedaka

A: The S"A says you should give the amount of tzedaka if you are able to but the Rambam says give tzedaka till you are not able to give. There is a machlokes if maser is dirabanan or diurissa the Chofetz Chaim says nowadays anis are every where so maser is diurissa the poskim say always say bli neder to avoid neder issues when giving tzedaka.Everybody must give a shlish shekel which you fulfill by giving a dollar at the door. The S"A says tzedaka saves you from ra and HASHEM will have mercy on you when you give tzedaka

CHASSIDIC PEARLS BY RABBI LAZER BRODY PARSHAS Va'etchanan

"Hashem, your God, has commanded to you to make the Sabbath day" (Devorim 5:15).

The above passage seems peculiar. During the time of our Holy Temple, may it be rebuilt soon, the head rabbinical court, or Beit Din, had the power to declare a leap year and add a 13th month, or to decide whether a month will be 29 or 30 days long. As such, Hashem empowers our wise men with the ability to influence when the holidays will fall, according to their decisions in the Beis Din.

If the Beit Din declares a leap year, then Purim, Pesach, and all subsequent holidays will fall a month later. By declaring a "full month" of 30 days, the upcoming holiday is pushed off by a day. Yet, no matter what the Beis Din decided, Shabbat remained Shabbat, and is forever on Saturday, the seventh day of the week! If that's the case, then how can Hashem command us to make the Sabbath day? Only He can make the Sabbath day!

SEDER ZERAIM IS ALMOST DONE WANT TO MAKE A SIYUM ON SEDER ZERAIM B/4 YOU KNOW IT YOU CAN SO GO TO KESHER STAM AND GET STARTED

THE OU'S Taryag: The 613 Mitzvos mitzva 32. Ain’t Gonna Work on Saturday: The prohibition against performing labor on the Sabbath

The kind of work prohibited on Shabbos is called melacha, meaning creative labor. There are 39 melachos: ploughing, sowing, reaping, binding sheaves, threshing, winnowing, selecting, sifting, grinding, kneading, baking/cooking, shearing, whitening/bleaching, combing, dyeing, spinning, threading the warp of a loom, threading the heddles of a loom, weaving, separating into threads, tying a knot, untying a knot, sewing, tearing, trapping, slaughtering, skinning, tanning, smoothing, scoring, cutting, writing, erasing, building, demolishing, kindling a fire, extinguishing, completing an object, and transporting an object between domains (or through a public domain). These are the labors that were necessary for the construction of the Mishkan (Tabernacle) and they demonstrate man’s mastery. (“Melacha” shares the same root as the word “melech,” meaning a king. The other word for labor is “avodah,” sharing the same root as “eved,” a servant.)

THE OU'S Taryag: The 613 Mitzvos mitzva 31. Yom HaShishi: The obligation to sanctify the Sabbath verbally

We are commanded to remember Shabbos, but that doesn’t mean rolling over in bed and thinking, “Oh, yeah… it’s Saturday.” Rather, we are commanded to praise the day out loud, over a cup of wine. We call this “Kiddush,” meaning “to sanctify,” since that’s what we were commanded to do. Likewise, we escort Shabbos out through the analogous blessing of Havdalah, which marks the separation between “holy” time and “secular” time.

THE OU'S Taryag: The 613 Mitzvos mitzva 30. I Knew That!: The prohibition against needless swearing

While our practice is to avoid swearing as much as possible, there are times when it is necessary and appropriate, specifically when called upon by beis din (the court) to testify. But there are certain things about which one may not swear, as doing so is needless, silly or just plain wrong.(DAF YOMI CONNECTION)

The Rambam’s Eighth Principle: A Negation is Not Its Own Negative Mitzvah

A person can be commanded to do something (“Eat matzah on Pesach!”) or not to do something (“Don’t eat shellfish!”). A mitzvah is either positive or negative, but a single statement can’t be both. A negation, however, is not a separate mitzvah. (We should mention that Rambam uses the Hebrew word sh’lilah.)

What’s a negation? It’s simply the reversal of what a statement would otherwise say. “I did not sleep last night” is the negation of “I slept last night.” It’s not a command at all. In Hebrew, a negation would commonly (but not exclusively) occur when the word “lo” (“no” or “not”) is added. “Lo achalti” (“I did not eat) is the negation of “achalti” (“I ate.”)

The Daf Yomi - In-depth practical case-study analyses derived directly from each day’s Daf. SHEVOUS DAF 20 WHEN IS THE YAHRTZEIT

Q:When is the yahrtzeit for a person the death or burial and what do you do on that day

A:The S"A says no meat or wine and you should fast on the yahrtzeit Rav Shternbauch the Chazonish and the Steipler say that if by fasting on the yahrtzeit you will not be able to learn do not fast. The Trumas Hadeshen brings a proof from our gemara which says someone made a neder day father died and see churban Yerushaliem who can eat(9 days connection) so to day of death who can eat so the yahrtzeit on day of death. The Shach says for the aval and family the yohrtzeit and year are bad mazal they need teshuvah the Mahram Mitz says it is a caparah for the father who died on this day the Arizal and KS"A say the zcus of children doing mitzvos torah and masim tovim the father goes higher the Rema says yahrtzeit is not by death but by burial we do not follow this. When the person dies on Thursday but is not buried till Monday big shilah when the yahrtzeit of the 1st year Shach and Masas Binyamin minhag olam is yohrtzeit 1st year is day of burial but if death is Thursday and burial is Friday the yahrtzeit on day of death.Rav Moshe says 1st year yahrtzeit on day of burial but after that yohrtzeit on day of death but the Taz argues and says every year yahrtzeit on day of death.
I heard Rav Wosner and Rabbi Zev Cohen say in this case 1st year yahrtzeit on day of burial after that the yahrtzeit on day of death

My son-in-law, Chananya Kramer of Yeshivas Ner Israel in Baltimore, heard the following story from his mother, Mrs. Shana Kramer, who witnessed it as a child. Mrs. Kramer is the director of Torah Umesorah's Creative Learning Pavilion. The episode happened more than 30 years ago, in Aurora, Indiana, in a summer camp for Orthodox children from midwest cities such as Cincinnati, Cleveland, Dayton, and St. Louis. It is still remembered vividly by all who saw it.

I want to thank everyone for your thoughts and tefillos on behalf of our little tzaddikel..

(For those of you who haven't yet heard, I had a c-section 4 weeks ago.  My baby was born 6 weeks early, and underwent emergency open heart surgery when he was 1 day old.  He is now hospitalized in Hadassah Ein Kerem's PICU).

B"H the heart surgery was successful and his heart is healing well, but we have now encountered other problems.  He has lots of fluid building up in his chest cavity, and so far he has been unresponsive to treatment.  The doctors are now deciding what step to take next.

Please daven that we should be zoche to find the right refuah for Tinok ben Yael, without him having to endure any more unnecessary pain.

Also, as a zechus for his refuah, I am encouraging women to try to bentch licht 10 minutes early this week, and to daven for him by Hadlakas Neiros.  (please note that if you make early Shabbos, you cannot light earlier than Plag).  The power of Kavod Shabbos is very strong, and I hope that this zechus will help bring about his refuah, bekarov!

Wishing you a good Shabbos,
Yael
