A:The Rama brings 2 yeish omrims the 1st one says bais din will not hear the case the 2nd yeish omrim says bais din will hear the case the Rama says the iker is the 1st yeish omrim the Nesivos says this only applies once the din is completed in non jewish court but if the din is not completed bais din would hear the case
