BAIS HAVAAD ON THE PARSHA ~ PARSHAS MISHPATIM ~ Ribbis: Lending with Interest



This week's Parshah discusses many Mitzvos pertaining to the dealings between man and his fellow. One of these Mitzvos is the prohibition of taking interest when loaning one's friend. When referring to the concept of interest, the Torah uses the word "Neshech," which literally translates as a bite. Rashi explains that interest is similar to the bite of snake. Just as when a snake bites someone's foot it often doesn't cause him immediate pain, but as the poison flows through his body he begins to feel pain, and can gradually deteriorate to a life-threatening condition, so too with interest payments on a loan, the borrower doesn't feel the pain until it accumulates to an unbearable debt.
This week's Journal will explore some of the Halachos of the prohibition of Ribbis - taking interest on a loan.

The Torah relates the episode in which Yisro suggests to Moshe Rabbeinu to set up a judiciary to judge the Jewish nation. Yisro told Moshe that he should instruct the judges, "את הדרך ילכו בה ואת המעשה אשר יעשון- The way in which they shall go and the action that they shall do." The Gemora (Bava Metziah, 30b) explains that the Torah is giving two instructions here: Firstly the judges should adhere to the law as laid down by the Halachah. Secondly, there is a Mitzvah from the Torah to act לפנים משורת הדין - to go beyond the strict letter of the law. we will clarify and explore the Torah's view on going above and beyond the actual Halacha & conducting our businesses and social lives on the ......up and up.

The Torah tells us about what occurred at Marah, the first stopping point where the Jews camped after their deliveration at the Yam Suf. The Torah tells us "שם שם לו חק ומשפט -there He gave them laws and judgments." Rashi explains that the Torah is telling us that we are commanded about some of the mitzvos of the Torah there, namely the Mitzvos of Shabbos, Parah Adumah, and Dinim, even before we got to Sinai. The Targum Yonasan Ben Uziel explains that Dinim here is referring specifically to the laws concerning the obligation to pay for causing personal injury.(PARSHAS BESHALACH)
