His reply in typical understatement: "All my life I never hurt a human being." An understatement, because he went out of his way to bring comfort and accommodation to others." Today marked the 35th yahrtzeit of Rabbi Moshe Feinstein zt"l. See below to read an article written by Rabbi Nosson Scherman for the Jewish Observer in 1986.

  • Agudath Israel of America is urging Senate committee leadership to ensure that nonpublic schools are treated equitably in the full allocation and use of funds directed to the nation's elementary and secondary schools. See below.

Agudath Israel Advocates for Full Measure of Equitable Treatment for Nonpublic Schools in COVID Relief Bill

As another Covid Relief bill moves through Congress, Agudath Israel of America is urging committee leadership to ensure that nonpublic schools are treated equitably in the full allocation and use of funds directed to the nation's elementary and secondary schools.  

The current House proposal allocates $129 billion for K-12 schools to help them safely reopen and address lost time in the classroom. However, the provisions of the bill limit the nonpublic school share to twenty percent of the total, and that amount to be used only for "learning loss."  

But as Rabbi Abba Cohen, Agudah's Vice President for Government Affairs and Washington Director, welcomed the allocation, he also pointed out in a letter to Chairperson Patty Murray (D-WA) and Ranking Member Richard Burr (R-NC) of the Senate Health, Education, Labor and Pensions Committee, that limiting "equitable participation" to this single purpose – learning loss – leaves nonpublic schools bereft of vital aid. "Like their public school counterparts, the needs of nonpublic schools go far beyond learning loss and extend to a broad range of health and safety issues."  

Opening a larger amount of aid to broader use is particularly compelling for many nonpublic schools, particularly in the Jewish community, the letter further noted, in light of their demonstrated commitment this past year to reopen their schools at significant cost for in-person learning in a safe environment for students and teachers. 
 
"At a time of crisis, Congress should expand flexibility and options for all schools so the funding will most optimally serve its purpose of providing true relief" concluded Rabbi Cohen. 
PCS/Madison Title Announce Registration for Property Management Course
PCS, a non-profit division of Agudath Israel, and Madison Title are proud to launch the next class of their acclaimed Property Management Course. Classes, to be given by industry experts, will cover management, preservation, and improvement of multifamily properties. Also, learn to manage multi-family properties efficiently and profitably.  

The course is directed at property managers, aspiring property managers, and those that are seeking to broaden their real estate knowledge.  

A partial listing of topics to be discussed include: building systems, managing employees, property maintenance, tenants, marketing, social media, reputation, management, utility control, cost management, inspections, budgeting, accounting, halachic challenges and solutions, working with owners, and building a property management business.  

The course duration is 12 weeks, with evening classes once a week.  

PCS and Madison Title are hosting a virtual open house for anyone interested in the course, this Monday, March 1st, 7:30 PM EST.

Aneinu Update - Please Daven for Refoel Avraham Yitzchak ben Gittel

On Taanis Esther on which power of tefila is great, we can daven for Refoel Avraham Yitzchak ben Gittel as he needs a lot of tefilos for a Refuah Shleima. I was asked to ask to especially daven today, in Purim and Shushan Purim. May Hashem listen to all our tefilos and bring a refuah to all the cholim bimheira!!

VICARIOUS (SECONDARY) LIABILITY: WHO IS RESPONSIBLE?

Case:  In common law, there's a concept of vicarious responsibility, where an employer is sometimes responsible for the actions of his employees. For example, in a restaurant, if the cook – who is just an employee – serves something that is spoiled and someone gets food poisoning, he can sue the restaurant and the employer will be held liable.

Question: How would that apply to the halachas of shutfim? If two partners own a restaurant and one serves something that's spoiled, is the other partner liable?

Answer: This is an area where halacha takes a very different view than modern law. While the law does have a concept of vicarious responsibility, and an employer is liable for the actions of a low-level employee, halacha has no such notion. Halacha says that if someone does something wrong, he is liable, and no one else is responsible. Even if someone would deliberately send a messenger to injure someone else, he would not bear responsibility, as the halachic rule is that "ain shliach l'dvar aveirah (One can't claim he was sent to do this aveirah, if he did it, it is his fault.)"

The same is true of a partnership. If one partner causes damage to someone else, the other partner is not liable according to halacha.

There are Poskim who argue that in today's world there is a clear common custom to hold a company responsible through vicarious liability. If a low-level employee damages someone's property – for example, if an employee in a dry cleaners ruins someone's suit – all the parties understand that it is accepted that the business is implicitly liable according to common practice. Therefore, these Poskim claim that since halacha recognizes common custom as binding, one could hold an employer or partner liable in today's society.
