THIS MONTH'S YORUCHA TOPIC:

Shabbos and Commerce

הלכות מסחר בשבת

Week 1 Focus:

מלאכת פועלי ישראל בשבת

  • THREE TYPES OF WORKERS
  • SECHIR YOM
  • WHAT A SECHIR YOM MAY NOT DO
  • A BUSINESS THAT CANNOT CLOSE ON SHABBOS

Introduction

There is a common misconception that a "shabbos goy" may be used for any melachah that a Jew cannot perform himself. Chazal expressly prohibited amira l'akum, i.e., having a non-Jew perform melachah on behalf of a Jew, even if he does so of his own volition. Chazal did allow for certain specific exceptions, and one utilizing the services of a non-Jew must ensure that it conforms with these halachos.

Points to Ponder

• As there is a prohibition upon meleches akum, what role does the "shabbos goy" play?

• If a non-Jew performs melachah for his personal benefit, can a Jew also make use of it?Must a non-Jewish partner be restricted from working on Shabbos?

• Can prescheduled service providers, such as gardeners and landscapers, work on a Jew's property on Shabbos?
