Week 2 Focus:

מקח וממכר

  • CAN A CHILD ENGAGE IN COMMERCE?
  • THE TAKANAH OF PEUT OS
  • A CHILD GIVING A GIFT
  • BACK TO OUR CASE
  • CHILDREN AND REAL ESTATE
  • OTHER TRANSACTIONS

Introduction

The basis of commercial transactions is the knowledge and consent of the parties involved. Although

a child below bar or bas mitzvah is generally not assumed to have daas, the chachamim did recognize

certain benchmarks at which time children can be involved in a limited amount of commerce.

Points to Ponder

• At what age can a child engage in commerce?

• What are the special limitations that Chazal placed upon selling inherited real estate?

• If a child takes up employment, can they back out in the middle of the job?

• Can a child forgive someone who wronged them physically or emotionally?
