[chicago-aneinu] Last Boy in Japan Please Daven for Yaakov Yosef ben Reizel

Wednesday February 29, 2012 9:28 AM It is about nine months since Yaakov Yosef Grunwald’s appeal rejection, which set in motion transfer proceedings to Israel, and now, Matzav.com has learned, his release from Japanese prison could be imminent. A letter issued by the Japanese Justice Ministry yesterday indicated that it has taken the next step in extraditing Yaakov Yosef to Israel, where he would serve the duration of his six-year prison term. The Israeli yeshivah bochur, who was arrested in 2008 when drugs were found in a false bottom of his suitcase, is still in his Japanese detention cell, although all immigration procedures needed for the transfer have been completed for months now. The final release and deportation orders were signed months ago, and his belongings are packed and all ready to go. Askanim were pleasantly surprised back in early September when all the required documents, normally the biggest headache in a bureaucracy, were already signed and returned. The Israeli Ministry of Justice replied fairly quickly to a Japanese questionnaire asking where Yaakov Yosef would potentially serve the remainder of his sentence, in what conditions and when will he be eligible for early release under Israeli law. In a nutshell, what has held up Japan’s release of Yaakov Yosef is their reaction to what they deem to have been Israeli leniency in commuting the sentences of the previous two boys. The Japanese thus wish to have Yaakov Yosef serve at least two-thirds of sentence in Japan before releasing him. That will be in early April, at which time the Japanese are expected to permit Yaakov Yosef to be taken to Israel. Initially, there was hope that Yaakov Yosef would be transferred at least two weeks before Rosh Hashanah. The appeal of Yaakov Yosef, who had received a six-year sentence, benefited his friend Yoel Zev Goldstein, who received a rare acquittal in August and has already returned to Israel. Yossi, the first of the bochurim to stand trial, was sentenced to five to eight years in prison. Close to a year after his May 2009 verdict he was transferred to Israel. According to Japanese law, a prisoner is eligible for parole after serving a third of his sentence, while Israeli law requires serving two-thirds (although in Japan n one receives parole before serving 75% of a sentence). Yossi, who was now governed by Israeli law, still had quite some time to serve before completing the two-thirds to enable him to appear before a parole board. Therefore he requested that his sentence be commuted, which would mean he would be released on parole sooner. In January 2011, the Israeli Gov commuted his sentence to the more lenient interpretation of five years, of which he had already served nearly half. Yossi’s sentence was eventually commuted, which enabled him to appear before the parole board, and he was released on parole and is now bound to the strict parole conditions. The Japanese Ministry of Justice, upon hearing of the release last February and receiving information of various media reports that Yossi was “pardoned” triggered the Ministry of Justice in Japan to open an inquiry as to what had really happened to Yossi and under what circumstances was he released, and requested for a full account in order to verify whether Yossi was pardoned or merely released on parole. The Ministry of Justice in Israel had replied and had given a full report on the events that led to the release of Yossi that clearly stressed that he was released on parole rather than a pardon, but somewhere in the Hebrew to English translation it appeared to the Japanese that he had perhaps received a ”partial pardon” rather than the agreed parole. The red flags were then raised for the second time. The Japanese then asked for a full brief on Israeli pardon law and whether Yaakov Yosef could conceivably be pardoned prior to serving out his term. They also demanded further proof that Yossi was not pardoned, partially or fully. Nearly six weeks (November 1) after the Israelis had translated their pardon laws and sent it to Japan, there was notification of a correspondence from the Ministry of Justice in Japan and everyone was excited, because all that was needed was the final reply from the Japanese and Yakov Yosef was literally waiting by the door to be collected, but when the letter was opened, the excitement was over in seconds. The new letter from the Ministry of Justice in Japan was just raising further inquiries relating to those laws. Meanwhile, Yaakov Yosef is still waiting for the day he can see and hug his parents, and meet his sister’s husband, whom he has never met, and the child they had, as well as his new sibling who was born while he was in prison. Yaakov Yosef was the strong one among the three bochurim. The tantalizing taste of freedom which appears so near but keeps getting bogged down in a sea of bureaucracy weighs on him and his parents. Please daven for Yaakov Yosef ben Reizel. {Noam Amdurski - Exclusive for Matzav.com Newscenter}

In this week's Parsha the Torah tells how Hashem commanded Moshe Rabbeinu to instruct the Jewish People concerning bringing donations for the construction of the Mishkan. Although today we no longer have a Mishkan, nor a Bais Hamikdah, the concept of serving Hashem with one's money is very much prevalent, primarily with regard to Tzedakah, the Mitzvah of giving charity. The Torah, when commanding to donate for the Mishkan, states "From every man whose heart motivates him you shall take his donation." The Targum Yonoson Ben Uziel explains this to mean that the Torah specified not to force people to give donations, unlike some other mitzvos which the Beis Din is enjoined to ensure are carried out by all Nonetheless, the mitzvah of giving tzedaka is indeed enforced by Beis Din in some situations and for certain causes. Nowadays, Beis Din does not have the authority to actually force anyone to do anything, but there are instances in which Beis Din can apply social pressure to ensure compliance of the mitzvah of giving charity. Translated and abridged by Rabbi Chanan Morrison Parshat Truma The Torah reading of Terumah begins the section dealing with building the Mishkan (Tabernacle) and making the priestly clothes. These chapters are among the few in which the Torah places great emphasis on external beauty — art, craftsmanship, and aesthetics. Of particular interest is the protagonist of this unique construction: the master craftsman, Betzalel. The Midrash weaves many stories about Betzalel's wisdom and skill. In particular, the Sages noted the significance of his name, which means, "in God's shadow": "Betzalel's name reflected his wisdom. God told Moses, 'Tell Betzalel to make the tabernacle, the ark, and the vessels.' When Moses relayed the message to Betzalel, however, Moses changed the order, mentioning first the ark, then the vessels, and lastly, the tabernacle... Betzalel turned to Moses. 'Moses, our teacher, usually one first builds the house, and then places the furniture inside. Yet you said to make the vessels and then the tabernacle. These vessels that I will make — where shall I put them? Perhaps God told you, "tabernacle, ark and vessels"?' Moses replied in amazement, 'You must have been in God’s shadow and overheard!' [chicago-aneinu] Please Daven for Jonathan Pollard

SPECIAL REQUEST 4 Adar 5772 Please put out the word to Jews everywhere to intensify their prayers on Yehonatan Pollard's behalf THIS SHABBAT and Sunday and Monday while there are meetings between the Prime Minister and Obama. I know it is late notice to get the word out to all the shuls, but whatever you can manage will be a big help, I'm sure. It's very, very important that the Heavens be rocked with our pleas for Yehonatan ben Malka at this very auspicious moment. After all, his freedom is in Hashem's hands and HE can force a reluctant Obama to release him just as he forced Pharoh to release Bnei Yisrael from Mitzrayim. No other cause unites Bnei Yisrael like the desire to see justice for Yehonatan Pollard and unity will stand us all in good stead right now. Please repost this in your blogs and on your facebook pages. The matter is urgent. In the spirit of Purim and Pesach and with love of Yisrael, Devash

YWN[chicago-aneinu] Rav Elyashiv: “A Medical Miracle

According to doctors at Shaare Zedek Medical Center, the situation surrounding the condition of Maran Posek HaDor HaGaon HaRav Yosef Sholom Elyashiv Shlita is nothing short of a “medical miracle”. They are now talking about a timetable surrounding the rav’s possible return home. Yehuda Schlesinger of Yisrael HaYom reports the rav has returned to speaking with those around him and all assisted breathing adjuncts have been removed. One must remember that the posek hador, who is almost 102, davened korbanos on erev Shabbos by heart, not to himself but audible, for others to hear, to the astonishment of all those around him. He is very weak, but speaking with those around him and the rav is questioning what is planned for a Purim seuda. The doctors report “no one expected the rav to return home but now, this appears to be a realistic possibility”. The rav was in cardiac arrest, revived, and has undergone a number of life-saving procedures. Doctors are simply astounded, including the frum members of the medical team who understand the power of tefilla and the unique stature of the patient as a gadol b’torah.

JI Musical Misloach Manos from Aaron Razel 2012 edition

Every year, when Adar approaches, friends of Aaron Razel know that within a few days they will each receive a musical Misloach Manos from him. Each year, Razel puts all his other projects on hold in order to send out a new song for FREE “to increase the joy of Purim”. “It all began with one song that I recorded and gave to neighbors as mishloach manos,” says Aaron. Since then Razel has accumulated ten songs for Adar, and is now producing a CD collection of them. Now, even those who are not friends with Razel, along with the whole world, can enjoy his Divrei Shir. The first song was called “Ata Oseh SheTehey Yehudi”, or simply “Oseh SheTehey Yehudi.” Another song in the Misloach Manos (Manos is plural which means two) is a new song from Rabbi Shlomo Carlebach was not recorded before, but it was found on a rare and dusty cassette tape…

[Let the King, therefore,] ponder thoughts so that no one be banished from him.” The Metzudas Dovid, in his explanation of the phrase, “G-d spares no one,” posits that since Avshalom did not kill Amnon directly, he was liable to “death at the hands of Heaven.” Thus, the woman from Tekoah was hinting that the King should leave it to G-d to kill Avshalom when He sees fit.

YWN [chicago-aneinu] Update on Maran Rav Elyashiv

Yeshiva World Update on Maran Rav Elyashiv (Monday, February 20th, 2012) The following update was received from Rabbi Shlomo Kook on Sunday, 27 Shevat 5772 regarding the condition of Maran Posek HaDor HaGaon HaRav Yosef Sholom Elyashiv Shlita. The update comes from Rav Kook, the official spokesman for the home of the posek hador amid much disinformation being reported in the media, including the chareidi media. Rav Kook explains that on Sunday, there was a “substantial improvement relatively speaking, with an emphasis on the word relative” and the rav is responding to external stimulus now that he has been brought out of the medically induced coma. Rabbi Kook adds the tzibur is urged to continue being mispallel for the rav, Yosef Sholom ben Chaya Musha b’soch kol cholei am yisrael. He explained the gadol hador is much in need of Am Yisrael’s tefilos. (YWN – Israel Desk, Jerusalem)

BAIS HAVAAD ON THE PARSHA 5772 ~ PARSHAS MISHPATIM ~Arka'os: Litigating Before a Secular Court

(PLEASE LEARN FOR A RUFUA SHELAMA FOR THE GEDOLIM Rav Elyashiv -Yosef Sholom ben Chaya Musha, Rav Shteinman - Aaron Yehuda Leib ben Gitel Feiga, Rav Weiss - Yitzchak Tuvia ben Rikal, Rav Belsky - Yisroel ben Chana Tzirtel, Rav Yosef - Yaakov Chai ben Margalit And Telzer Rosh Yeshiva, Yitxchok Izak ben Trina Devorah for a refuah shleima b’soch kol cholei am Yisrael.)
In this week's parsha the Torah instructs us concerning the mitzvos of mishpat - monetary laws. It is noteworthy that this immediately follows the giving of the Torah on Mt. Sinai. Rashi explains that this is because the Torah wishes to emphasize that these mitzvos were also given on Mt. Sinai just as the Ten Commandments were. The Terumas Hadeshen adds a further elucidation. He writes that every society must have a system of justice in place, without which anarchy reigns. The Torah's laws of civil justice are essentially logical and understandable, and as such, one might have thought that Moshe legislated them himself, Heaven forbid. Therefore, the Torah emphasizes that these laws were divinely ordained and were instructed to Moshe on Mt. Sinai by G-d Himself. Rashi continues to explain that the first passuk of the parsha serves as a prohibition for Jews to adjudicate financial issues in a secular court. Rashi adds that in addition to this prohibition, there is a severe Chillul Hashem involved in doing so. This is because by turning to a secular court system one is equating its laws to those of the Torah, or worse still, preferring them over the Torah. This is a great slight to the Torah itself and therefore a Chillul Hashem.(AUDIO) FULL PRINT VERSION MORE AUDIO AND VIDEO

CHASSIDIC PEARLS BY RABBI LAZER BRODY PARSHAS MISHPATIM

We shall do and we shall listen (Shmot 24:7). The nations of the world have difficulty understanding how it's possible to "do", in other words, to implement a commandment, before they "listen" to the logic and the underlying rationale of the commandment. In such a frame of mind, they refuse to observe anything that goes against their thinking. In stark contrast, "We shall do and we shall listen" is the foundation of Judaism. Many people harbor the mistaken notion that one must be daft to "blindly observe" Hashem's commandments. But, for a faithful Jew, observance is never blind. A Jew with even a minimal measure of cognizance knows that The Almighty created the world; therefore, He alone knows what's best for the world in general and for each of His creations in particular. Shlomo Hamelech (King Solomon), the wisest of all men, said (Mishlei 16:32), "Self control is greater than capturing a city." Self control means winning the battle with one's own evil inclination, or Yetzer Hara. The Torah offers us the only proven strategy to win the battle against the evil inclination, the most difficult battle of all. First, we must do what the Torah tells us to, and only afterwards, ask questions.

Translated and abridged by Rabbi Chanan Morrison Parshat Mishpatim Amongst the various laws in Mishpatim — nearly all of societal or interpersonal nature — the Torah outlines the laws of compensation for physical damages. When one person injures another, he must compensate the damage with a financial payment covering five components. He must pay for permanent loss of income due to the injury, embarrassment and pain incurred, loss of work while the victim was healing, and medical expenses. This last component, that he 'provide for his complete healing' (Ex. 21:19), is of particular interest. The root-word 'to heal' appears 67 times in the Torah, almost exclusively referring to God as the Healer. Only here, as an aside to the topic of damages, is it made clear that we are expected to take active measures to heal ourselves, and not just leave the healing process to nature. This detail did not escape the keen eyes of the Sages. "From here we see that the Torah gave permission to the doctor to heal" (Berachot 60). Yet we need to understand: why must the Torah explicitly give such permission to doctors? If anything, we should expect all medical activity to be highly commended, for easing pain and saving lives.

After the revelation on Mount Sinai Moshe Rabbeinu begins to teach the Torah. I don't want to sound stupid but imagine after the revelation on Mount Sinai, wouldn't it be beautiful if Moshe Rabbeinu would give a lecture on the existence of G-d, or on the importance of being Jewish? But how does Moshe Rabbeinu begin? 'Ki SikneEvedIvri', when you buy a Jewish slave don't keep him longer than six years. On the seventh year he has to be freed. And if this slave says 'I want to remain a slave' then on the fiftieth year he has to be freed.

After Nasan Hanavi asked David to judge the case of the wealthy man who stole the lone sheep of the poor man, King David responded (verse 5), “David was very indignant about this man and he said to Nasan, 'As Hashem lives, any man who does this deserves to die.'” The commentators are perplexed at the severe sentence that King David was ready to meet out against the wealthy man. After all, according to normative halacha, fourfold payment, as is mentioned in the next verse, is the proper judgment. Why did King David feel such a severe sentence was in order?

In order to understand an important point made by the Kehillas Yaakov and others, a short introduction is in order. Chazal teach us that before going to war each of the soldiers of King David's army gave a “get”, a divorce, to his wife. This was done to avoid “aguna” situations if one of the soldiers became MIA. If a husband would be MIA, without having given a divorce before leaving to war, his wife would most likely never be able to remarry. According to Rabbeinu Tam, the divorce document given before departing to war was given unconditionally. Subsequent to giving such a divorce, just as seclusion between any Jewish male and female is generally prohibited, the former husband and wife could not be secluded.. For technical reasons, if the husband and wife would become secluded, the validity of the divorce can be thrown into question. With this background information in the forefront of our minds, we can now understand what was going on in Urya's mind in our chapter.

After we learn that Chanun, son of the King of Ammon, took over the kingdom upon his father's death, the verse relates what King David was thinking, “I shall do an act of kindness for Chanun, son of Nachash, just as his father acted with kindness towards me. So David sent [a message] to him by the hand of his servants to console him over his father...” According to the Rashi, King David is referring to the fact that Nachash, Chanun's father, protected King David's brother after the King of Moav murdered the rest of his family. As a gesture of gratitude, King David wanted to comfort the mourning Chanun. The Medresh Rabbah (Bamidbar 21,5 “Tzaror”) tells us that Hashem was upset with King David for comforting Chanun. “You went against My words. I wrote 'Do not seek out their welfare or good for all days' and you do an act of kindness towards them? The verse in Koheles says, 'Do not be too righteous.'” This medresh seems perplexing. The Kesef Mishnah (Laws of Kings 6,6) brings the words of the Yerai'im who says that it is permitted for a Jew to do an act of kindness to a person from Ammon and Moav if this is done to show gratitude for a good deed that that person did for him. If so, then how then do we understand, the Kesef Mishnah asks, the Medresh Rabbah which reveals to us that Hashem was critical of King David's behavior towards Chanan?

Verse six of our chapter reads, “Mefiboshes son of Yonasan son of Shaul came before David and fell upon his face and prostrated himself.” After reading this verse, we probably are reminded of other verses in Tanach that list more than two generations when identifying a person. We know that parshas Pinchas begins with, “Pinchas ben Elazar ben Aharon.” Parshas Korach begins with “Korach ben Yitzhar ben K'has ben Levi.” In each instance, Chazal and the commentators teach us special lessons that are to be learned from the seemingly extra generation(s) that are mentioned. What do we learn from our verse?

In our chapter, we learn of King David spreading his kingdom to what the gemora refers to as Suria. We find in verses five and six, “Aram of Damascus came to assist Hadadezer, King of Tzovah, and David struck down twenty two thousand men of Aram. David appointed authorities in Aram of Damascus and Aram became servants of David, bearers of tribute.” The gemora in Gittin (8b, 47) discusses if the conquest of Suria by King David is a conquest that bestows upon the land a sanctity which would obligate it in terumos, ma'aseros and perhaps other laws like Israel. Or perhaps the only obligations would be rabbinic. Rashi and Tosfos disagree why this conquest by David, which the gemora refers to a a “kibush yachid”, a individual's conquest, is referred to in this manner.

YWN Update on Maran Rav Elyashiv Shlita (12:15 IL)

Officials in Shaare Zedek Medical Center report that Maran Posek HaDor HaGaon HaRav Yosef Sholom Elyashiv Shlita remains in critical/stable condition at this hour, his 10th day in a cardiac intensive care unit. The rav this morning, Wednesday, 22 Shevat 5772 successfully underwent a procedure to secure a long-term airway, an alternative to the intubation that has provided a patent airway for the gadol hador during past days. The tracheotomy was performed successfully and the rav is recovering. The rav’s medical team is now deciding if they should bring the gadol hador out of the medically induced coma, a decision that is expected sometime on erev Shabbos. The tzibur is requested to continue being mispallel for Rav Yosef Sholom ben Chaya Musha b’soch kol cholei am yisrael. (YWN – Israel Desk, Jerusalem)

In verse nine of our chapter, G-d bestows a magnificent blessing on King David. The verse reads, “I was with you wherever you went – I cut down all your enemies before you and I gave you great renown, renown like the great men of the world.” The gemora in Pesachim (117b) says, “And I gave you great renown, renown like the great men.” Rav Yosef taught a braisa which reads, “That is what we say 'magein David' (one of the blessings of every haftorah) The Rashbam explains that Nasan the Prophet was quoting this as a message from Hashem. Just like we conclude a bracha “the shield of Avraham” so too we conclude a brocha “shield of David.” The Sfas Emes (Breishis Lech Lecha 5635) explains that when we say that Hashem is “magein Avraham” this means that Hashem assured Avraham that there will be a “bit” of Avraham in every Jew. This “bit” will be protected by Hashem. No one can eradicate it. We presume that this “bit” of Avraham is the root of faith in Hashem which Avraham developed and passed on to every generation and every individual Jew.

[chicago-aneinu] YWN Taanis for Maran Rav Elyashiv Shlita

HaGaon HaRav Chaim Kanievsky Shlita, a son-in-law of Maran Posek HaDor HaGaon HaRav Yosef Sholom Elyashiv Shlita, has called on the tzibur to accept a taanis on Thursday, 23 Shevat 5772 on behalf of the posek hador. Rav Kanievsky has stipulated however that this is only for those capable of doing so without negatively impacting one’s learning, for fasting at the expense of compromised Torah study will not have accomplished its goal. Doctors at Shaare Zedek Medical Center today, 22 Shevat, will attempt to extubate the gadol hador and replace the endotracheal tube providing his airway with a tracheotomy, a relatively minor surgical procedure by which an incision is made in one’s throat, entering one’s trachea and bypassing one’s mouth. Obviously, on a 101-year-old patient, no procedure is minor. While this was attempted earlier in the week, albeit without success, reports from the hospital signal today the physicians feel the move is critical for the rav’s continued treatment. The tzibur is requested to continue being mispallel for Rav Yosef Sholom ben Chaya Musha b’soch kol cholei am yisrael. (YWN – Israel Desk, Jerusalem)

Rava, in Tractate Sotah (35a) asks, Why was David punished by having Uzza die through him?” The gemora answers that this happened through David because he called words of the Torah “songs.” As David states in Tehillim (119, 54), “Your statutes were songs to me in my dwellings of fear.” To this statement of David, Hashem responded, “Behold, I will cause you to stumble regarding a thing that even schoolchildren know! As the verse relates (Bamidbar 7,9), “And to the sons of Kehas he did not give [wagons] for the service of the sacred [was upon them, they must carry upon the shoulder].”Yet, David brought the Ark on a wagon! The Mishptzos Zahav views this stumbling as a lesson in midah k'neged midah (measure for measure). David's mistake was in the fact that he referred to the statutes of Hashem as a “song”. In truth, to be successful in Torah learning a person must invest himself and all of his energy, without interruption, in his study. In contrast, to master a song and to maintain a mastery of a song, much less effort is required.

A short Insight into SHMUEL 2, Chapter 5 By Rabbi Nisson Dov Miller

(PLEASE LEARN FOR A REFUA SHELAMA FOR HARAV YOSEF SHALOM BEN CHAYA MUSHA) Verse four in our chapter reads, “David was thirty years old when he began to reign; he ruled for forty years...” Is there significance in the fact that King David began his reign at age thirty? R' Yehuda Hachasid (Sefer Hachasidim 504) gives us a glimpse into the depths and vastness of Hashem's judgment. He explains that Yehuda, son of Yaakov Avinu, was ultimately responsible for the sale of Yosef. Thus, Yehuda was responsible for the delay in Yosef finding a wife until he was thirty years old. Therefore, David, Yehuda's descendant, did not reign until he was thirty years old.

A short Insight into SHMUEL 2, Chapter 4 By Rabbi Nisson Dov Miller

(PLEASE LEARN FOR A REFUA SHELAMA FOR HARAV YOSEF SHALOM BEN CHAYA MUSHA) In our chapter, Reichav and Ba'anah stealthfully execute King Ish – Boshes while asleep in bed. They bring his head to King David expecting to see the King full of joy at the defeat of his rival. However, King David views this as the murder of an innocent man He thus has Reichav and Ba'anah executed and hanged. Then the chapter concludes, “Then they took the head of Ish Boshes and buried [it] in Avner's tomb in Chevron.” On the surface it would seem strange that Ish Boshes' head would be buried in Avner's tomb. After all, the Shulchan Aruch (Y.D. 262 ,6) reads, “Two people who hate each other should not be buried together.”

A short Insight into shmuel 2, Chapter 3 By Rabbi Nisson Dov Miller

(PLEASE LEARN FOR A REFUA SHELAMA FOR HARAV YOSEF SHALOM BEN CHAYA MUSHA) In our chapter, after Ish-Boshes accuses Avner of sinning with Ritzpah, a concubine of Shaul his late father, Avner offers King David his services to help consolidate his kingdom. King David agrees on condition that Avner returns Michal, daughter of Shaul, to King David. After all, Michal originally had been given King David upon his victory over Golaith. Subsequently, Shaul gave her to Palti ben Layish. The gemora in Sanhedrin (19b) inquires why Palti ben Layish is also called Paltiel? R' Yochanan explains that his true name was Palti. Why then was he also called Paltiel? He was called Paltiel because Hashem (the addition of e-l to Palti is a name of Hashem) helped him abstain from sinning with Michal, daughter of Shaul. What did Palti do? When he was given Michal, he realized that she had at least been designated for Shaul as a wife. Thus, he knew that he could not be intimate with her. For this reason, immediately upon Shaul Hamelech giving Michal to Palti, Palti stuck a sword between him and her. This sword symbolized the death by the sword that one being intimate with Michal would be liable. From that moment onward, Hashem assisted Palti in remaining steadfast in his resolve not to give in to the temptation to sin with Michal.

BAIS HAVAAD ON THE PARSHA 5772 ~ PARSHAS YISRO ~The Criteria of a Dayan

(PLEASE LEARN FOR A REFUA SHELAMA FOR HARAV YOSEF SHALOM BEN CHAYA MUSHA)
This week's parsha discusses Yisro's visit to Bnei Yisroel in the desert. During this visit Yisro noticed that Moshe Rabbeinu was acting as the sole judge and arbitrator of monetary disputes, and he advised Moshe to appoint more judges to serve Bnei Yisroel. He also suggested what the criteria for choosing the judges should be.He advised choosing "G-d-fearing men, men of truth, and people who despise money." From here, along with a verse in Parshas Devarim, the Rambam (Hilchos Sanhedrin 2:7) derives a total of seven qualities that one must have in order to serve as a judge. Thus, the Shulchan Aruch (CM 7:11) rules that when choosing a Dayan to serve on a Beis Din, one must take care to appoint a person who possesses these seven attributes. OU'S TARYAG Shemoneh Esrei #3 – Kedushos (Holiness)by Rabbi Jack Abramowitz

(PLEASE LEARN FOR A REFUA SHELAMA FOR HARAV YOSEF SHALOM BEN CHAYA MUSHA) As we will see in Mitzvah #433, there is an obligation for us to try to get closer to God through prayer. To help us fulfill this, our Sages established a prayer to be recited thrice-daily, corresponding to the prayers of our Forefathers. This prayer is called the Amidah (because it is recited standing); the weekday version is also called Shemoneh Esrei, the Eighteen Benedictions (although a nineteenth has since been added). Once a week for nineteen weeks, we will review the contents of the 19 blessings of “Shemoneh Esrei.” The focus of the third blessing is God’s holiness. We know that the Torah is holy, Israel is holy and God is holy, but what exactly is “holiness?” Kadosh, translated as “holy,” more specifically means that something is special and set apart from the herd. This specialness approaches uniqueness but God, Who is One of a kind, is the Most Holy and the source of all holiness. The blessing addresses God, saying that “Your holy ones will praise You every day, forever.” On one level, this refers to God’s ministering angels, who praise Him constantly (as we will discuss further in a moment). On another level, it refers to the Jews, a nation apart, who praise God daily through prayers such as this. During the public repetition of the Shemoneh Esrei, this bracha is where the interactive Kedusha is recited. In this prayer, we emulate the manner in which the Heavenly beings praise God. For example, this is why we stand with our feet together, since angels are described as having a single “straight leg” (Ezekiel 1:7). We recite verses praising God’s attributes of holiness, particularly as sung by the angels: “Holy, holy, holy…” is from Isaiah 6:3, “Blessed is the honor…” is from Ezekiel 3:12 and “God will reign forever…” is from Psalms 146:10. (That last one is from King David, not from the angels, which it why that phrase is prefaced with, “And in the words of your holy ones it is written…”) During the Ten Days of Repentance from Rosh Hashana through Yom Kippur, the closing of this blessing, normally “ha(k)Eil haKadosh” (“the holy God”) is replaced by “haMelech haKadosh” (“the holy King”). This reflects the time’s enhanced attribute of justice (as opposed to that of mercy, which has more sway the rest of the year).
