Dear Friends, 

In a year filled with change and adaptation, the OU Women's Initiative has been changing and adapting with the needs of our community and world at large. Within the guidelines of social distancing, we have discovered new ways of connecting women through Torah learning and leadership, bringing together women of all ages, from around the world.   

This year, we have experienced tremendous growth, providing intellectual, professional and personal learning opportunities to thousands of women. Our mission is to support, engage, and connect women through Torah and its values. Whether through Torah text itself, such as in our Torat Imecha Nach Yomi Audio Series, in which professional female educators teach the insights of Nach daily, or by translating its wisdom into professional and communal application at our Lay Leadership Summits, public speaking workshops, and Cope and Hope seminars regarding the challenges of everyday life during COVID-19,  we are committed to serving the community.  

As the Yamim Noraim approach, we are already planning on making an even great impact and reaching more women in the upcoming year. With your help, we can make this goal come to fruition together.

USING KNOWLEDGE GAINED FROM A FORMER EMPLOYER

Question: If an individual works for an employer where he gains knowledge, skills, and possibly access to proprietary information (such as systems or programs that he helped create), and then leaves his position to create his own business, may he use the knowledge and information gained from his previous employer?

Answer: The basic issue at hand in questions like this is whether any system or program that the employee is paid to create for the employer belongs to the employer or not. Within halacha, this issue of the status of intellectual property is discussed at length among the Acharonim.

According to the Beis Yitzchak and Shoel Umeshiv, intellectual property has the same status as a physical object, and appropriating it from the owner is considered gezel.  According to the Chasam Sofer, intellectual property may not have the same status as physical property, but it is still problematic to take such information or ideas and use it, since it is considered yoreid l'soch chayav shel chaveiro, interfering with the livelihood of another, which is similar to retzicha in some sense.

On the other hand, it is clear that if a person develops expertise in a certain field on the job, that expertise is certainly his. Any employer understands that when an employee reaches a certain level of experience and expertise, he may have to pay the employer a significantly higher salary or the employee may leave to start his own business.

We can thus summarize by saying that a program developed for an employer is defined as an object (or a "cheftza") and cannot necessarily be taken by someone else without permission (either due to gezel or due to harming someone else's livelihood), while a person's abilities and expertise is considered as part of the person (a "gavra"), and he may use those capabilities in whatever manner he desires. The boundary between these two concepts is sometimes ambiguous and often industry specific. Since this is a complicated issue, and the cases vary, one should consult a Rav with knowledge of choshen mishpat for his individual needs.

 A young child is in critical condition after drowning in a swimming pool in Indiana, YWN has learned.

The three-year-old child from Chicago was with her family on vacation in Indiana, when the tragic incident occurred.

The child was rushed to a local hospital and was then airlifted to a Chicago hospital.

Mrs. Eliana Sohn-Cohen is a Project Manager for the OU Women's Initiative. Before joining the Women's Initiative in January 2019, Eliana worked for Yeshiva University, first as a Project Coordinator for the YU School Partnership's professional development division and then as the Programs Manager for Alumni Relations and Special Projects on the Yeshiva University campus in Jerusalem. An avid writer, Eliana's writing has been featured by The Jewish Press, Times of Israel, YU Torah To-Go, The Layers Project and Nefesh B'Nefesh, in addition to serving as a copywriter for nonprofits and agencies. She earned a BA in English Literature from City University of New York, Queens College and a MS in secondary Jewish education from Yeshiva University's Azrieli Graduate School of Jewish Education and Administration. She and her husband live in New Rochelle, New York.

Agudath Israel of America is partnering again with the COVID Plasma Initiative and the New York Blood Center to host a COVID-19 plasma drive in the heart of Flatbush.  

The drive will take place this Tuesday, September 1st, 1:30 PM-7:30 PM, at the Kingsway Jewish Center, 2902 Kings Highway.
