Introduction

In many neighborhoods, especially rural ones, it is common for residents to use shortcuts and easements across private property. Chazal give the public certain rights over these areas, and the owner may be restricted from repossessing them for himself. 

Points to Ponder

• Under what circumstances does a shortcut become public property?

• Does this halacha apply to individuals who have been using a path, or only to public paths?

• If a community need arises, can everyone be forced to chip in?

• Can a resident in a shared building complex be compelled to chip in for things he doesn’t need or want if the majority of residents want it?
