Introduction

Collecting a debt can often be a difficult process. The Torah requires utmost sensitivity to the borrower, and one must not pressure him if he cannot pay. On the other hand, the borrower is obligated to make every effort to pay his debt, including selling off his assets and avoiding any expenditures.

Points to Ponder

• Can a lender apply pressure to a borrower if he suspects he may have money or assets that he hasn't disclosed?

• If a borrower does not have money, can he be compelled to take a job in order to pay his debts?

• What are the rules of seizure for an unpaid debt – do we leave the debtor with anything for himself and his family?

• If a borrower claims not to have money but he has a luxury home or car, can he be forced to downgrade?
