Having established the prohibition of bringing a dispute to a secular court, several related issues need to be clarified. For example, contracts often contain language that gives the courts jurisdiction over any disputes. Alternatively, people often opt for arbitration panels outside of the court system.

Points to Ponder

• Can a non-Jew be selected as a judge or arbitrator in a dispute between Jews?

• Is it permitted to sue a Jewish practitioner in a secular court in order to get money from his insurance?

• If a Jew went to secular court without a heter arkaos, can the other party sue him in Bais Din for his legal fees?

• Can a Jew sign a contract that states that all disputes will be settled in a secular court? If he did sign, can he go to court to get what he deserves according to the contract?
