Introduction

The most crucial component of the Din Torah proceedings is the pursuit of "tzedek", justice. This

requires that both sides be on equal footing. This is understood in the literal sense, for example, that

both are given equal time and attention; but also perceptively, i.e. neither party can be made to feel

that the odds are stacked against them in some way.

Points to Ponder

• How should a Bais Din treat the litigants to ensure they feel like equals?

• What is the Halacha regarding ex parte communication, before or during the proceedings?

• Is there a discovery process before a Din Torah, and is the other side entitled to see all the evidence?

• Must a Bais Din explain their reasoning for their psak to the litigants, and is there any

system of appeals?
