THIS MONTH'S YORUCHA TOPIC:

Bais Din 2/Secular Courts

הלכות בית דין חלק ב' וערכאות

Week 3 Focus:

תוכן הענינים

  • THE SEVERITY OF GOING TO SECULAR COURT
  • HETER ARKAOS
  • THE SOURCE OF THE HETER
  • RESPONSIBILITY FOR THE COURT FEES
  • ZONING BOARDS

Introduction

The severity of bringing a dispute between Jews to a secular court cannot be overstated. Chazal use the strongest of terms against people who do so, even if the ruling of the court will be in line with Halacha. Only one who received prior permission from a Bais Din may bring his case to a secular court.

Points to Ponder

• If both parties consent to bring their case to a secular court, is it still forbidden?

• What is the source of a "heter arkaos", the permission from a Bais Din to go to a secular court?

• If one of the parties will surely not arrive to Bais Din, is a heter arkaos still required?

• Does the prohibition of arkaos apply to local zoning boards and the like?
