THIS MONTH'S YORUCHA TOPIC:

Shabbos and Commerce

הלכות מסחר בשבת

Week 2 Focus:

 דיני קבלנות בשבת

  • A KABLAN
  • EXCEPTION #1: TELLING A KABLAN TO WORK ON SHABBOS
  • EXCEPTION #2: WORKING IN PUBLIC
  • WHEN NOT WORKING WILL CAUSE A LOSS

Introduction

One of the permitted categories of meleches akum is when the non-Jew is hired as a kablan, one who is paid for the performance of a job (as opposed to a sechir yom who is paid for his time). Even then, he may not be expressly instructed to work on Shabbos, and it cannot be obvious that he is working for a Jew.

Points to Ponder

• Can one ship merchandise when the delivery is scheduled for Shabbos? May one accept a delivery of merchandise on Shabbos?

• If a worker isn't told to work on Shabbos, but the window of time he is given to perform his duties is too narrow to complete it during the week, is that the same as instructing him to work on Shabbos?

• What should one do if his business cannot be closed on Shabbos, e.g., one who operates

a nursing home?
