Subject: WEEK TWO: Don't delegate authority without knowing the halachos

Week 2 Focus:

שליח ששינה

  • IF AN AGENT EXCEEDS THEIR AUTHORITY:
  • A SHALIACH WHO OVERPAYS
  • THE AGENT'S RESPONSIBILITY
  • THE RESOLUTION OF THE RAAVAD
  • THE RESOLUTION OF THE OTHER RISHONIM
  • APPLYING THE ANSWERS
  • HOW MUCH INFORMATION MUST THE AGENT SHARE?
  • WHAT IF THE SELLER IS A SHALIACH?

Introduction

A shaliach is empowered by the principal to act on his behalf, presumably for the principal's benefit. If he deviated from his instructions, even a little bit, the principal can invalidate his actions since he wasn't authorized to take them.

Points to Ponder

• If the shaliach erred in his agency, is the transaction voided automatically, or can the principal validate the transaction and hold the agent accountable?

• Can the other party require the agent to uphold the transaction on his own if the principal claims it to be void because he deviated?

• Does the other party have to know that he is dealing with an agent in order for the deviation to void the transaction? Must he know the identity of the principal?
