A lease agreement is generally viewed in halacha as a temporary sale. Accordingly, the terms of the agreement are not halachically binding until a valid kinyan is performed. Once there is a valid kinyan, the renter "owns" the rental for the duration of the lease
Points to Ponder
• Can a landlord commit to a future lease while the property is in the hands of another tenant?
• Is a landlord able to terminate a lease if he needs the property for himself, e.g., his own house became uninhabitable?
• If a tenant has a change of circumstances and no longer needs the rental, can they cancel it or ask for a rate reduction? Can they provide a replacement tenant?
