By taking possession of a rental, the renter assumes the role of a paid custodian, albeit with regular usage rights. He is thus liable for theft or loss even if he did not misuse the item. If he did misuse the item in any significant way, he becomes liable for any mishap that occurs.
Points to Ponder
• How do we determine the proper usage of a rental? If he overused it, must he pay more rent?
• If a renter allows someone else to make use of the rental and a mishap occurs, who is responsible for it?
• Is it ever permitted to sublet a property to another tenant? If it is subleased at a higher rate, who is entitled to the additional rent?
• If the renter did not return the rental on time, must he continue to pay rent?
