Week 1 Focus:

העברת נחלה

  • MAY ONE IGNORE THE ORDER OF YERUSHAH?
  • THE SHTAR CHATZI ZACHAR
  • GIVING NON-HEIRS WHEN SOME
  • GIVING PROPERTY AWAY WHILE STILL ALIVE
  • GIVING OF ONE'S ESTATE TO TZEDAKAH
  • THE JEALOUSY FACTOR

Introduction

Although there are methods whereby a person can alter the order of inheritance, Chazal castigate people who do so, even if they have good reasons for it. Common custom, however, is to make certain changes, such as by giving daughters a share in the inheritance even when there are sons.

Points to Ponder

• Is altering the Torah's order of inheritance forbidden, or is it merely inadvisable?

• If Chazal advise against changing the order, why do people typically leave their daughters a share?

• Common custom is to leave a substantial amount of one's inheritance to charitable causes: how does this align with the admonition against altering the order of inheritance?

• Should a person ensure that all their children get an equal portion in order to avoid jealousy? What about the double portion of the bechor?
