THIS MONTH'S YORUCHA TOPIC:

Custodians

הלכות שומרים

Week 1 Focus:

קבלת שמירה

  • THE FOUR SHOMRIM
  • HOW DOES A SHOMER PROVE HIS INNOCENCE?
  • THE DIFFERENCE BETWEEN A SHOMER AND OTHERS
  • HOW DOES ONE BECOME A SHOMER?
  • IS A KINYAN NEEDED?
  • MAZIK
  • A SHOMER CHINAM'S RESPONSIBILITY
  • TECHILASO B'PESHIA V'SOFO B'ONESS

Introduction

When a person takes responsibility for the property of others without specifying the terms, the

Torah provides a framework of liabilities, divided into four main categories: unpaid guardians, paid

guardians, borrowers, and renters.

Points to Ponder

• How does a person become a Shomer? Is a verbal commitment enough to make him liable?

• What are the responsibilities of an unpaid guardian?

• If the guardian is unsure of what occurred to the item, is he required to pay for it?

• In a case where the guardian was negligent but something else occurred that may have happened even

if he had been careful, is he liable for his negligence?
