Introduction

The Torah makes a special exemption from the liabilities of a Shomer in cases of b'aalav imo, when

the owner was working on behalf of the Shomer at the time he took possession. This exemption

applies even to a Shomer who was negligent; however, if the Shomer gave over the item to another

unauthorized person and it was damaged or lost, the Shomer will be responsible.

Points to Ponder

• For b'aalav imo to apply, when exactly must the owner be working for the Shomer, and what kinds of

work must he perform?

• Does b'aalav imo exempt a Shomer who inadvertently damaged the item himself?

• At the end of a rental period, is the renter still liable for theft or loss until the item is returned?

• Can a borrower or renter allow other people to use the item?
