When it comes to rentals, perhaps the most common point of contention is the issue of repairs and maintenance. Like most areas of monetary halacha, the common custom will be a primary factor in determining who is responsible for the upkeep of the rental property. Still, many things aren't clearly defined, and oftentimes there are unforeseen circumstances where there is no common custom.
Points to Ponder
• What are the landlord's obligations toward the tenant prior to and during a rental period?
• If the rental became unusable, must the landlord provide an alternative, or can he simply
terminate the agreement?
• If the landlord does not provide a necessary repair, can the tenant withhold rent and use it
toward the repair?
• Can a tenant demand a discount for parts of the rental that weren't working properly, or for times that he couldn't use it?
