Introduction

Borrowers and renters differ from regular guardians in that they take possession of the item for their

own use. A borrower has the highest level of liability because his possession of the item is solely for

his own benefit. A renter has a lower level of responsibility because the owner also receives a benefit

in the form of rent.

Points to Ponder

• If a lender receives a small amount of benefit, is the borrower still responsible for onessim?

• What are the parameters of maisa machmas melacha, damage or loss through the regular use of the

item, that would exempt even a borrower?

• Is a renter required to actively guard the item as if he was a paid guardian?

• Suppose a renter uses the item in a way that isn't its regular use, is he considered a sholaiach yad and

responsible for onessim?
