Introduction

A paid guardian is liable for the loss or theft of the item in his care, even if he was not negligent. He is not liable for onessim, mishaps that could not have been avoided. If, however, he made use of the item for his own benefit, he becomes fully liable even for onessim.

Points to Ponder

• What is the minimum amount of pay a guardian must receive to be in the category of a Shomer Sachar?Does it depend on the value of the item?

• If something happens to the item, does the Shomer Sachar forfeit his wages?

• How is shelichus yad, unauthorized usage of the item, defined in halacha?

• Which items are not subject to the laws of Shomrim altogether? Is there a way to include them?
